My friend has been working for a nursing home as a CNA for a year. She recently graduated as an LVN and the D.O.N told her that she will start orientation. She signed all the paperwork and gave copies of her license, but did not talk about wage. The D.O.N recently quit right after and did not give the papers to management. Her first paycheck and she still got the wage of a CNA. She then called asking about her pay and she asked if she would get reimbursed and they told her that she wont get the paid. so is that illegal working as an LVN for 2 paychecks [a month] and still getting paid CNA wage without getting reimbursed?

Unless she's union they can pay whatever they agreed on.

It sounds absurd. But did she or not start oriientation?? Did her title change, get a new ID???? If that is the case maybe its taking them long to adjust. My friend was a CNA, then RN, it took them a whole a month and half before they adjust her salary. But they explained upfront , there is a proccess... so maybe your friend need to ask the process, how long it will take stuff like that. I do not think it matters becase the person who hired her left....there a bunch of people involved in hiring someone. You made it sound like a private hiring. Your friend need to get down on business and ask management in person and in writing.

she started in september. her title changed and got a new ID. But they are telling her that for the 2 paycheck for september she will not be paid the difference from CNA to LVN.

I don't think they have done anything illegal , but they have shown clearly how much they care about / respect their staff .
so for the last month working as an LVN and getting paid half her wage simply because of some error of not sending some papers that had nothing to do with her, but with management she wont get paid for it? can you please explain how it isnt illegal to be getting paid for a title that isnt her title anymore?

she should of discussed wages first thing when she was signing the paperwork... no it's not illegal at all.. she learned the hard way.... i think i would go to the new DON and get it fixed... if there was no set wage when she was first hired ... she got paid the same as being a CNA....

i had a job long ago as a staff nurse and was eventually promoted to supervisor. i was paid every 2 weeks (meaning i received 26 paychecks per year instead of 24) and was told it would take 2 or 3 paychecks to reflect my new title and payrate but that i would receive a check every payday in the interim and that eventually i would receive an adjustment check. four checks later (8 weeks), i opened my check and there it was... finally! all in one lump. it had been lumped in with my regular rate and my shift differental had vanished because i was now one of them ... a lower rung member of management... do some checking and questioning but don't appear anxious or hostile. be low key and keep panic and any sense of being bullied out of your voice -- you'll lose any power and oomph you need to have. practice beforehand if you think you mght cry. i have been known to cry when i get angry and that makes you lose the edge you need. good luck.

It would be incumbent upon you (your friend) to suggest the law which is being broken.

Check with labor board. It may be as someone else posted they will pay retroactively. I hope she kept copies of all her paper work. Never,ever turn in anything wo keeping copies!

She made a big mistake in not asking about her new salary before showing up even one day with her her role and title. That's a lesson she won't forget any time soon. Has her pay now been updated to that of a LPN? I hope so.
It's completely scummy not to reimburse her the money and if they were honorable they would do it. Without something in writing with her new pay rate for that time they don't have to pay her the new wage. I would call the labor board and see if they can help. If she is union tell her to call her rep immediately.
If she can't collect the wages she might want to think about changing jobs. While they might legally be in the right it's ethically despicable.

If it isn't in writing somewhere, like maybe their policies or pay grade, she may not have much to stand on. I agree 100% with the PP though, except I'd go one further and say she needs to look for a new job right now. Obviously they do not care about their employees at all there. What they did to her was really crappy.
