I would like to share my account of what happened to me the final semester in nursing school...how I failed the final semester of nursing school, was dismissed from nursing school, then fought back and won in monumental proportions in court.

There is much disturbing evidence and testimony to indicate that I was used by my nursing school as a cover up for an egregious grade fixing scandal by them. Upon information and belief, I sued on counts of fraud, discrimination, and breach of contract (breach of the covenant of good faith and fair dealings).

I have not the time now to fill in on details. But would like to add that the school used a rather clever and deceptive way to fix the entire outcome of a semester gone bad.

Please share your thoughts on this...more details coming later.

I don't care how many follow-up posts the OP puts out. This story is FICTION.

I would sue the school, not because I didn't 'benefit from the fraud' but because I paid this school in good faith to give me the education necessary to obtain a degree in nursing. This school has shown 'bad faith' practices by altering grades in order to help some students pass, while allowing others to fail. If a program is going to raise a grade to passing, you can't assume they wouldn't drop a grade to failing. By the last semester many people are $20k+ in, and it's all out fraud if the program is behaving in such a manner.

You'd sue if you didn't pass? Any personal responsibility here? The school agrees to provide you the education you pay for, whether or not you pass is up to you

Bottom line, OP FAILED the course work and is bitter because the school didn't "fix" his grades like they did for other students (in his words, none of his story can truly be verified because of the confidentiality agreement).

FWIW,what the lawyers do or do not do in their conduct of the case in court is not "evidence."

And I always used to tell students that if they put half the effort into learning the material that they put into disputing exam questions and their grades, we wouldn't be having this discussion.

This is ridiculous! OP FAILED a class. Point, period, the end! How do you know that the people failing going into the final didn't pass with a 74.6 or a 75.0. YOU DON'T! And to sue a school to get your way? You have a lot to learn about life.

I'm sorry, but I hope these "passed but failed" students can't pass the NCLEX because it frightens me to think someone with subpar knowledge could be a functional nurse. And if OP failed even with a grading curve....yikes! :eek:

The OP comes of as...well annoying, I'm just saying. They type as if they're copying things word for word from some law website or forum. On top of that, their snide responses that come off as arrogant push me to say that the post is total crap. I'm involved in risk management and I HIGHLY DOUBT that a lawsuit would award you MORE than a hospital being sued over a patient suicide claim. Try again. Oh and my snide response...you still failed, didn't pass, and won't be a nurse. So how can you sue over years of service that never woulda happened?

My unit's schedule rules clearly state the each nurse will work 2 Fridays per 4 week schedule. I was scheduled for all 4...some nurses worked none!!! Plus, if you put an 'R' on the request sheet for a given day, that means you will get that day off. So I had an R that the scheduler ignored, plus there is the "4 Fridays" issue. I think that's a pretty good lawsuit, right?

About the lawsuit part. Although schedule guidelines are not always followed to the "letter of the law" every time--but that is a different thread.

Whew! LOL Show me a floor that claims to do scheduling by the book....good luck. I have a hard time believing it exists!

Now that you mention it- when I worked in the hospital 12 hr shifts were supposed to be done by seniority. I'd been there 4 1/2 years and got stuck on a ton of 8 hour shifts one schedule because my manager was mad at me while the new grads were working 3 12s. I should totally sue.
