I would like to share my account of what happened to me the final semester in nursing school...how I failed the final semester of nursing school, was dismissed from nursing school, then fought back and won in monumental proportions in court.
There is much disturbing evidence and testimony to indicate that I was used by my nursing school as a cover up for an egregious grade fixing scandal by them. Upon information and belief, I sued on counts of fraud, discrimination, and breach of contract (breach of the covenant of good faith and fair dealings).
I have not the time now to fill in on details. But would like to add that the school used a rather clever and deceptive way to fix the entire outcome of a semester gone bad.
Please share your thoughts on this...more details coming later.
This is the most absurd post I have ever seen. If you knowingly failed the course and "found out" about the grade fixing scheme, you are just a bitter person. I wouldn't want a nurse who failed a course. If you are honest with yourself learn from your mistakes and try again work to improve your weakness. Why don't you do better at school and be involved with your coursework. Instructors aren't at a school to fail you, they want to educate you to be a better nurse.

This is ridiculous! OP FAILED a class. Point, period, the end! How do you know that the people failing going into the final didn't pass with a 74.6 or a 75.0. YOU DON'T! And to sue a school to get your way? You have a lot to learn about life.

THIS! The OP is failing to acknowledge this. The only reason he/she sued is bc the grade fixing scandal did not benefit them. OP you need to take responsibility for your actings. Maybe you didn't study enough or your head was not in the game. Professors don't give grades you earn them. Even if the school had passed you do you think that you would be able to sit for and pass the NCLEX?Irish to answer your question no I would not trust this nurse taking care of me or my family. They seem like the type of person to make excuses for everything and complain about how the world is against them.
OP also even if you do have court documents to prove that you're telling the truth I'm sure you wouldn't be able to share or discuss it. Usually there is clauses in a settlement agreemement to prevent you from speaking out about this case. I would be careful if I were you this is a public forum and the school would be able to sue you for breaching the settlement. I'm surprised your lawyer didn't advise you of this

I wouldn't trust you either as a nurse taking care of me and my family leaving irrational comments like you do. My question for you is this, why would the school dismiss me then later give me a substantial settlement to avoid a jury trial? If you get dismissed from nursing school, you're not supposed to even get a dime of your tuition money or other related expenses back. Then why did the school offer me any settlement at all? Why wasn't the case thrown out? If it was a frivolous lawsuit, the defending attorney would have filed a motion to dismiss, then the judge would have heard the motion and thrown out all counts of my case if he/she thought it was frivolous. But that's not what happened bro. My case went unchallenged for 20 months by the opposing attorney. He seemed baffled by the bizarre circumstances surrounding the case. At times the opposing attorneys got hostile to each other; my attorney saying, "Sir! Sir! Sir!" with the other attorney replying, "This isn't your deposition!" As far as if the school sues me if I breach any terms of the settlement contract, well I hope they do! And I hope after they sue me that the case goes to trial so I can hear what they have to say about all of the mysterious and suspicious grade changes because up to now they are claiming they did nothing wrong that they just went through all of the semester's tests at the conclusion of the semester and found correct answers not applied all semester long for certain students! And maybe you can come and watch that trial! Bro you have a good day.
I would sue the school, not because I didn't 'benefit from the fraud' but because I paid this school in good faith to give me the education necessary to obtain a degree in nursing. This school has shown 'bad faith' practices by altering grades in order to help some students pass, while allowing others to fail. If a program is going to raise a grade to passing, you can't assume they wouldn't drop a grade to failing. By the last semester many people are $20k+ in, and it's all out fraud if the program is behaving in such a manner.
Finally a rational comment and thank you for it. I had no other choice but to sue. As far as I'm concerned I did not fail the course. The school advertised a passing final average of at least 75. That raises the question, 75 percent of what? The school did not utilize a clearly defined passing standard but rather used one that was "arbitrary and capricious". I failed the course because the school needed to fail a small number of students to make the outcome of the semester look realistic as so many students were failing all semester long. It was a subjective, arbitrary decision for the school to fail me and shame on them for that.

Damn, I'm sorry I called you bro if you are a female. My bad. I thought you might have been a male based on the comment you wrote. But I do think the terms of use of this site prevent you from actually naming schools. Better read the fine print.

The payout of a settlement is not necessarily an admission of guilt....it is a statement that they don't want to deal with a long expensive court battle and insurance companies feel it is easier to "pay it off".
We also need to remember that we can all agree to disagree without being disagreeable.
28studentsfailed- I don't understand why you would even post anything about this. You got yourself into this situation by having a failing grade in the first place. Some people benefit from a curve, some don't. Yes, you apparently won a "substantial" settlement, but at the end of the day you still failed and you are not allowed to sit for the boards to become a licensed nurse. Just let it go. My advice, take your "huge" settlement and go back to school. This time study harder, don't fail, and finish without needing help from a grading curve.
Lol OP, didn't you honestly think by posting on here we all would be supportive of you? I think you can tell by the majority we are not. There are outliers who agree with you but the most, do NOT. There was clearly a curve witch you didn't even pass with. So take your dirty money & find another school. But this time, study & don't expect your grade to be handed to you. Even if you pass next time, I would not want my family members treated by you!
