I would like to share my account of what happened to me the final semester in nursing school...how I failed the final semester of nursing school, was dismissed from nursing school, then fought back and won in monumental proportions in court.
There is much disturbing evidence and testimony to indicate that I was used by my nursing school as a cover up for an egregious grade fixing scandal by them. Upon information and belief, I sued on counts of fraud, discrimination, and breach of contract (breach of the covenant of good faith and fair dealings).
I have not the time now to fill in on details. But would like to add that the school used a rather clever and deceptive way to fix the entire outcome of a semester gone bad.
Please share your thoughts on this...more details coming later.
So you are suing because you didn't benefit from the fraud? I don't think you deserve a penny.
I would sue the school, not because I didn't 'benefit from the fraud' but because I paid this school in good faith to give me the education necessary to obtain a degree in nursing. This school has shown 'bad faith' practices by altering grades in order to help some students pass, while allowing others to fail. If a program is going to raise a grade to passing, you can't assume they wouldn't drop a grade to failing. By the last semester many people are $20k+ in, and it's all out fraud if the program is behaving in such a manner.
Can you name the school? We have a lot of pre-nursing students at Allnurses and it might be good for them to know that this school should be avoided.
No...as per the Terms of Service the school cannot be named.

The school promises you an education..... they don't promise you will pass. Here is what concerns me in this scenario....this school had an unacceptable failure rate and may have stood to lose or not obtain their accreditation status. Passing rates/percentages are reported to the BON and they would be investigated....so they did the next best thing...they graded on a curve...passing now a greater percentage of the students.
What REALLY concerns me.....the OP still failed.....even with a curve they had an insufficient grade to leave/graduate the program. Is this person qualified enough to graduate and sit for boards then care for me or my family? Do the people they passed with the curve have the education to sit for boards and care for patients or my family?
If the evidence was sufficient that they committed fraud, and the OP had the grade to pass and was wrongly failed, I'm surprised the lawyer didn't go for gold.
So this is a story of almost 40% of a nursing class is failing and with grading on the curve some still failed. That tells me that nurses that should have failed graduated a program when they should have failed......and .....the ones who were failing still failed are angry they weren't included.

The OP failed. Earned a failing grade. Failed. Nothing changes that the OP failed and is mad he/she didn't benefit from the "scam". You want him/her being your nurse? No thanks....OP is a failure and should benefit from that. No.

THIS! The OP is failing to acknowledge this. The only reason he/she sued is bc the grade fixing scandal did not benefit them. OP you need to take responsibility for your actings. Maybe you didn't study enough or your head was not in the game. Professors don't give grades you earn them. Even if the school had passed you do you think that you would be able to sit for and pass the NCLEX?
Irish to answer your question no I would not trust this nurse taking care of me or my family. They seem like the type of person to make excuses for everything and complain about how the world is against them.
OP also even if you do have court documents to prove that you're telling the truth I'm sure you wouldn't be able to share or discuss it. Usually there is clauses in a settlement agreemement to prevent you from speaking out about this case. I would be careful if I were you this is a public forum and the school would be able to sue you for breaching the settlement. I'm surprised your lawyer didn't advise you of this
Exactly.Lets hope that the school loses its accreditation, the NCLEX does its job, and getting a job without a single reference is impossible.
I sure hope so, I don't want a nurse taking care of me or my family member that did not deserve to pass nursing school- the students falsely passed or the OP. You are right in that these types of people always have an excuse for everything and nothing is ever their fault. "But I only failed by 0.5 points"- too bad, you still failed and new the grading system before you tested!
While I understand that in some cases a large amount of people failing could be a school scam, but everyone always uses the percent of class that failed to mean that there was something wrong with the class or professor as an excuse to their failing- I think if someone doesn't do the amount of immense work required or does not understand the material then they deserve fail regardless of what percent of the class it is.
