I would like to share my account of what happened to me the final semester in nursing school...how I failed the final semester of nursing school, was dismissed from nursing school, then fought back and won in monumental proportions in court.
There is much disturbing evidence and testimony to indicate that I was used by my nursing school as a cover up for an egregious grade fixing scandal by them. Upon information and belief, I sued on counts of fraud, discrimination, and breach of contract (breach of the covenant of good faith and fair dealings).
I have not the time now to fill in on details. But would like to add that the school used a rather clever and deceptive way to fix the entire outcome of a semester gone bad.

This looks like a hoax. If something like this really happened, it would have been reported somewhere.
Oh man, I couldn't find a date on it anywhere! I know it takes a while to get through a lawsuit, but two years seems a bit extreme.
Ok, so here's the situation...imagine the final semester of your nursing school: many students are failing the whole semester say like 30% to 40% of the class. Graduation comes and 95% of the class passes and graduates. And you are in the 5% of the students who doesn't pass/ graduate? Wouldn't you be suspicious?
Subsequently, over the next several weeks/months tips came in that only solidified my suspicions, some of which were very heartbreaking, for lack of a better word.
All students who failed the course sued the school on the very premise that the school used a passing standard that was arbitrary and capricious and that final grades were changed until they (the school) passed who they wanted to pass.
Evidence in the strength of my case against the school:
- The courts give school/colleges/universities a lot of lee-way in the legal system yet despite this, the defense was not able to crumble my case.
- Defense attorney never filed a motion to dismiss the case knowing that no rational judge would ever dismiss it.
- Defense attorney never filed a motion for summary judgement, knowing that he couldn't win that way either.
- On the day of what was to be the trial, the Defendants conceded a substantial settlement to avoid an embarrassing jury trial that they would have more than likely lost. I wanted a trial and told my attorney that no amount of money could replace the truth. However, he coerced me into settlement claiming the school had insurance issues and it would have been difficult to collect on the jury award. Sorry, I cannot discuss the terms of the settlement as I agreed to a confidentiality clause.
I feel both humiliated and used by the school and I think if you were in my situation, you would have sued too!
Moreover, the school presented a defense that was "narrow, weak, absurd, and hardly believable."
More very sad, convincing evidence:
- the failing grade of 74.4 I received, with 75 being passing...well there was no correspondence with that score and the percentages of what the exams were worth as listed on the corse syllabus. In other words, given my test scores and the weighting of what the exams were worth, when making that calculation, an entire different result came out
- I was told by a certain instructor that there was no mathematical way that I could pass the course by means of the ATI re-test given my final average, then was issued a different final average in which I could have passed the course by means of the ATI re-test.
- Final grades were issued to students on May 13, then an entirely different final grade was issued to all students on May 17, keeping in mind the very definition of final is: "incapable of being altered...last...terminal.
- It was impossible to calculate your final average given the course syllabus or any other document issued to students.
Again, thank you all for the replies. There is much more to this case, especially the clever/sneaky way in which the final grades were actually fixed. Feel free to ask me more questions. I will also gladly divulge some of the very disturbing tips which came to me after i was dismissed from the program- a few of which absolutely convinced me to sue. Have a nice day!
