I confess to back pedaling into Trump territory when I wanted to leave discussions about him in the garbage can. My thread on the read-only break room site has 9,600 replies so I thought I'd bring up a new one.

Haberman's book is out based on interviews. I won't read it, but the excerpts are interesting. Especially what he says about McConnell, a description that's against the Terms of Service here, but I actually don't disagree with. LOL

That's an interesting question. Historically, members of the Judiciary interpret and apply constitutional tests and questions. This question of Trump's eligibility wouldn't be different.
Funny how the 14th amendment never came up until a former president attempted to interfere in the peaceful transfer of power and told lies about election results until his radicalized and angry fans attacked the Capitol and disrupted the congressional joint session formalizing his loss. Funny.

It's like these people believe that the prosecutors should stop because of the threat of violence. It will all just be better if we ignore evidence of crimes because of threats of violence. It sounds like one big crime family.
It's easy to be skeptical about our legal system holding wealthy powerful white men accountable in meaningful ways.

I'd be interested in knowing what experts you're talking about. While I'm gratified that a couple of strict originalists agree with me, it is what I want to hear, after all. The tricky bit about "experts", it's awfully hard to asses reliability when I don't practice in their area.
Plus, you wrote that the indictments didn't "do as intended" ... what is your take on what was intended?

Raffensperger wrote an op-ED Wednesday in The Wall Street Journal saying he did not have the authority to use the 14th Amendment to block Trump from the ballot — and suggesting it would be unwise for election officials elsewhere to do so.
"Georgia law contemplates a legal process that must take place before anyone is removed from the ballot,” he wrote. "Anyone who believes in democracy must let the voters decide.”
Court cases and History will tell us how this part of the constitution can be implimented/enforced as important part of our DEMOCRACY: CItizens electoral votes choose our elected officials.

Asked why he ignored them, he said: "I didn't respect them as lawyers." Kristen pushed back "but you hired them". He added that he did not listen to campaign attorneys because those lawyers were "RINOs,” He accepted the suggestions given to him from other outside attorneys, but the ultimate decision was his: "I listened to myself. I saw what happened... my instincts are a big part of it, that's been the thing that's gotten me to where I am". Thus, it will be difficult for his current attorneys to say he was depending on legal counsel in Federal January 6th lawsuit brought by Special Counsel Jack Smith.

Trump is delusional. He is mentally ill and unable to acknowledge or admit reality as related to his electoral loss. The media wants us to worry about Biden when THAT is the cognitive capacity of the GOP front runner. Propaganda works.

Yep. I think that Biden is old but he is effective, surrounded by competent professionals who seem to be staying out of trouble, and Biden is a much safer choice than the GOP candidates who ignore Trump's corruption and toy with the idea of pardoning people who would set aside our constitution to pursue authoritarian temptations. Biden's mental competence questions are primarily a projection from Trump's team than gets elevated by media to balance the reality that Trump is a mess.
