STUPID PARENTS!! (vent here)

This may not belong in this forum but it will have nursing issues involved. On October 30th my 9yo child was ran down by another child on his mountain bike. I say ran down because this is what he did---chased her through our yard with her screaming noooo go away!!!! She fell down, he ran her over, broke her arm approx 3 inches below the head of the Humerus, then rode on home with her left screaming bloddy murder in our yard. I took her to the ER where I work and the xray showed it was below the growth plate but was displaced a great deal. There was nothing they could do that night about it (very rural hospital). She had to see an orthopedic surgon in the am approx 100miles away. He said there wasn't enough to pin so she had to keep a sling on with a wieghted chunk of plaster hanging on her elbow for traction, no cast or anything. She missed out on the trick or treat thing (bothered her alot), missed a little over a month of school(was her right hand), had to sleep sitting up in a recliner to keep it in alignment. Needless to say this was very traumatic for a 9yo girl to deal with as it was for her 36yo father (me)

The boy that ran her over has had no punishment in any way. Was out riding his bike the next day. His parents have offered nothing, not even an "I'm sorry", and they know exactly what he did. The law in Nebraska states the parent is accoutable for only $1000.00 of injuries that thier child causes. The kid can blow up a house and they have to pay for all of it--but hurt another child--1000.00 bucks. My ER bill was that much for gods sake. She had 5 visits to the orthpidic doc--have not seen thoses bills yet. We have no health insurance, could not get it and pay the bills as well--$500.00+ a month for family coverage. My DD went through all this, my family is screwed money wise, I'm so mad I'm about to go nuts.

I hate irresposible parents.:angryfire I am so close to letting my 12yo son go over and break that kids arm and then say-"thats for my sister--now we are even" but no I will not I AM a responsible parent.

Sorry about the long long LONG rant--had to get it out of my system.

That's awful! I'm wondering if there are any other loops you can get around to get them, maybe you could get a phone consult with a lawyer?

Can you press charges against the boy that ran your daughter over? That's assault!!!

Were the police called? Sounds like he chased her down, he could be charged with assault, if the parents wont reprimand him.

I did not want the post to be a page long all by itself so I did leave some out. Yes the police were called--quote from the county Att.--"what do you want me to do, arrest a 9yo boy? I don't think so!"--nothing more done about that.

The Nebraska law/statute was given to me by a lawyer friend that also investigated the home owners insurance--they have none. I'm just screwed--The lawyer said I will get a judgement for $1000.00, that's it--and after looking into it further ---would not even see that unless I sued to get his paycheck garnished. That would cost more than it was worth.

YES!!! he should arrest a 9 yr old boy!!! If he'd been 19 he would have been arrested in minutes!

I agree and said so, but it is well known around here that the county att. is about as useless as teets on a boar hog(I am in the middle of farm country here). The only time he will do his job is if you are one of the wealthy that own everything around here, THEN you can get anything you want out of him. BTW he is also in private practice in the county as well--BIG conflict of interest if you ask me.

Sounds to me like some country justice is in order!

Is there some reason you can't get a lawyer and sue the parents in a civil suit?

The statute/law that I spoke of is just that---all a parent can be held accoutable for, in a civil suit or otherwise, is $1000.00 for bodily harm/medical expense/pain and suffering--the works. This is from the lawyer I spoke to. He even sent me transcripts of a lawsuit that upheld this STUPID law within the last 10 yrs. I can't believe there is such a limit on bodily harm/medical expenses, but no limit on tangible property. Where did that logic come from? STUPID STUPID STUPID:trout: :angryfire

I have thought about it ALOT--but it wouldn't solve my families problems, and I don't think this kid would learn anything from it either. I know the parents are scumballs, I would like VERY much to knock the father on his lazy azz, but all that would do is land ME in jail, then there is the assult charge, SBN would just LOVE that one.

I thought I've see cases that th child was sued as well for the damages. The child can be held responsible for the damages, it's just you won't be able to see any of it until he's 18 and starts working so it can be garnished. I'm not sure if that is your state or not, but I'm pretty sure I've heard of something like tht before. Buthe expense of court costs is just going to get added to the medical bills. Because you would still have to get those paid off and wait for compensation from him if you were to win a suit. Sucks. Think that maybe the parens should be the one getting the boroken arm for not teachi their child better and paying attention better to what he is doing.
