Quit Job and Now Accused of Abandonment

I quit my job without notice. I had a very good reason to do that. I am a manager and not responsible for patient care. No one was abandoned. Everyone was safe. 

I sent an email about my resignation including my reasons and a higher up person (not a nurse) stated that my company would be filing a complaint with the board of nursing for patient abandonment because I did not give notice. 

I know it’s BS. But I want to hear from you if this has happened to you and how it played out. 

I already have a lawyer specializing in whistleblowers. Just need to hear from people who’ve been there and the moral support.

I applaud you for standing up for safe patient care. From what I know of the definition of patient abandonment this is not it. As described above it's when you accept a patient assignment and then... abandon it. Pretty self explanatory. Can you really get in trouble for "abandoning" a job? I know it's polite to give notice if you can but people have to quit suddenly for many reasons.

A year and a half ago, as I was being escorted out of Wrongway by an administrator and security guard after receiving my letter of termination, the HR director told me that if I posted on allnurses again, "the hospital will take action".

Heh.

We don't know the details of your employer's behaviors/actions that led to you quitting without notice- but we do know they issue meaningless threats.

I was a DON and gave only 2 weeks notice instead of the customer 30-day notice.  I was threatened with, "There's a good chance you  won't be eligible fo re-hire because you did not give the proper notice."  Yeah - I'm shakin'!  ?

Let them try to accuse you, they are not going to win their case. You didn’t accept an assignment and they quit on the spot. Plus if you were hired as an at will employee, then you can leave if you want with or without notice just like they can let you go the same way. I know times are hard and it’s difficult to find staff but if you didn’t feel that the work conditions were safe, then it’s time to blow the lid on this joint. Good thing you got a lawyer.

Resignation is not abandonment. In order to be guilty of abandonment, you would have to have accepted a patient or patients into your care, then either walked off the unit or failed to provide care.

This is a new scare tactic some agencies (Sharp Medical Staffing) and some hospitals (one of the hospitals in Guam) are using to try and use fear to make you stay because nurses are quitting in high numbers for multiple reasons (burnout, vaccine mandates, chasing travel money). We all know what abandonment is and is not, but they are stilling trying this tactic. Don't be scared and call them out by name on their scare tactics so others will avoid them.
