my nursing career is gone!

Nurses LPN/LVN

Published

I was discharged from my job because IDPH says I come to work drunk and beat up on residents...Well I'm not a drinker and I dont beat up on old people...in fact the resident they say I did something to gave me a hug when I came in the door before I found out I was fired now what is that?

I get so tired of working in nursing homes and I'm really tired of it now! Many of the other colleagues stated "that is ridiculous" I wonder if I could take the administrator and IDPH to court for lying and defamation

character can anyone give me advice or know a lawyer??:banghead:

Isn't that stupid I worked there a year never miss adays work and always good to the residents and family members even they say that was not right...:uhoh3:

IDPH - IL Dept of Public Health. In IL, our BON (board of nursing) is the IL Dept of Public Regulation.

(At least this is my guess of what the OP is talking about).

no they couldn't do that because they have no proof

That doesn't matter they can still report you for it. Are you in the US? Because if you are, you need a lawyer.

I agree with the other postings. If you want to continue to be a nurse, don't think about fighting as "starting trouble". I would get a very good lawyer and start the ball rolling because at the end of the day, it's their word against yours. You have to fight!

If my character was being called into question or my professionalism as a nurse I would be straight onto a lawyer for advice.

Are you in a state that is unionized and are you a part of that union? Do you carry ? They will pay for a lawyer in some cases and there is always arbitration. I was fired unjustly and immediately fought back. Not only did they have to give me my job back they had to reinstate me with full benefits and any money I did not make while i was away. Since moved away and on to better things, but stand up for yourself.:twocents:

Ok- I am not a nurse -yet. But- I did work at an Outpatient Rehab that worked with IPN (Intervention Project for Nurses) which closely followed nurses that were turned into the BON for substance abuse.

I do not know you- but I highly suspect that the facility you worked for would not make an accusation like this out of thin air. I cannot imagine "working under the influence" would be their choice of reason for letting you go. They could probably come up with something far less severe if they only wanted to get rid of you.

In the state I worked it- it was the responsibility of the facility to report substance abuse. BON would give the nurse the option of losing his or her license or go have their license suspended and go for help through the IPN program. IPN would then send the nurse for a substance abuse evaluation- and if they needed inpatient they sent him/her there or for outpatient treatment. So long as the nurse stayed clean and in the program they were able to gain their license back.

My point is- if they fired you for (suspected) working under the influence- they are going to report you. It would be negligent of them not to.

"this whole post seems really, really weird to me... just my opinion..."

very much agree with this..something just does not ring right.

In Australia we would involve our union. You need to protect yourself. If there is no union, then call a lawyer if you are innocent. You need to protect your registration and your qualifications.

what is an IDPH? I know what BON is and thought everyone who is a nurse or gonna b a nurse knows what BON is. LOL! BON= board of nursing. Are you a nurse? oh and I'm sorry to hear that you got fired from your job. How awful. You should get a lawyer and fight for your rights and that is defamation they did. I wish ya good luck. ((hugs you)):nurse::icon_hug:

Hey who or what is BON and do you think I have a case?

It's the board of nursing for your state....and yes you need a lawyer NOW.

The title of the thread says it all... that your nursing career is gone. That would suggest that you understand the seriousness of these accusations, so I'm not sure why you are hesitant to consult an attorney. Trouble schmouble, I say, get thee to an attorney forthwith.
