So, I two months into my nursing program, after passing my background check, I was at my b-day party and got into a fight. I called the cops and needless to say, I was the one arrested. I was charged with two counts of assault IV. I called both Oregon and Washington Boards of Nursing and both say that it's not cause for automatic denile, but it would more than likely be cause for an investigation and up in the air as to whether or not I could be licensed. Well now, a year later, I am done with school, filing for the NCLEX and having to answer yes to the 'Have you ever been...' question. I am SO nervous. Does anybody know the chances of them letting me sit for the NCLEX? Has anybody ever had this or heard of someone with assault(s) being licensed? I know I messed up royally, but figured I should at least try instead of thinking 'what if' forever. Thanks!

as you already know (deep down) no one on here can really answer your question. even if he/she went through the same situation your situation will be investigated without being compared to another (at least that is my limited understanding) so another's experience may be of no consequence. on the other hand, you came to the right place for support and to vent. you may take longer to be allowed to sit for the nclex then someone without such an offense or it may take you no time at all. all you can do now is relax (i know... easier said ....). the good thing is you put yes! there is nothing worse then putting "no" when there is something to investigate. good luck to you.

I answered no criminal record on my exam application last month with NCBON. I sat for the test and passed. After three days I still did not have a license number so I emailed my contact at the board. He checked into it for me and next thing I know the Criminal Coordinator was asking for my fax number to send me a letter. She did so and it stated the Board was 'holding' my results because I committed fraud on my application. The CBC revealed a fraudulent check from 1995. I had to get certified copies of restitution, type a letter of who, why, what, where and when, and also verify current employment (why I do not know). I even had to send a copy of my social. After turning in all this I cannot contact the Board for 10 working days! Find out if you have a record and be honest. They will penalize you and the worst feeling in the world is actually KNOWING you passed but cannot get licensed. Hopes this helps.

I can't believe they would make you wait even though you passed. So is the BON not going to license you or did you eventually get your license to practice?

By answering NO when you should have ansered YES to criminal history conviction,is considered lying + fraud on application to the BON and grounds for denial of license. Follow your states BON directives, submit paperwork and most are granted license. :) Recent BON rulings have placed persons on restricted licesse for first 1-3years.

It depends a lot on how individual states handle sealed/expunged records. GET AN EXPERIENCED ADMINISTRATIVE ATTORNEY - someone familiar with how YOUR state handles licensure issues. Have the attorney contact the Board of Nursing, and clarify whether or not you have to self-report a sealed/expunged charge. This varies a lot by state. In Ohio & Indiana, for example, you must report even sealed/expunged matters. In Kentucky, however, you may not need to.

I have a felony assault charge on my record from 1990. I stabbed an ex-boyfriend who was abusing me for the past year. Despite the fact that I was the one who was being battered and had a nice shiner to prove it, the police took both of us in.

On my forms, I explained in full detail what happened. The Florida BON did not stop me from taking my Boards and I received my license. They did do a thorough investigation though that took a few weeks. Believe me, I was sweating it out the whole time.

Make sure you write them a very sincere and detailed letter stating what, where, when and why. It should move the process along for you.

Well I am in a similar situation in 2000 i got arrested for driving out a license and speeding. I forgot all about it and it came back to haunt me the department of financial and professional regulation send me a letter that is requesting a detailed letter of what, when and why of each situation and an original certified copy of the court documents indicating the charges. Well to my good luck i don't have any papers of that arrest! I need help as to what direction to turn. Needless to say that i passed my LPN nclex in December and to this point i have not been license. First it was the fingerprints the vendor didn't do it's job and it's the results. As I am sitting writing down I have now graduated as an RN but cannot get license as an LPN.

don't let this stop you from moving forward.... get background info gathered needed by bon to issue license. its great that you can present "rehabilitaitve evidence" for surviving and graduating from rn program!
