Im really biting my nails about this. A while back i worked for walmart and i was fired for shoplifting. cops were not involved at all they did not press charges they just told me i wouldnt be able to get re hired by any walmart or sams club..I learned my lesson from my mistake it was the first time i had done it and the last time i did it. Now i got my cna diploma im in good standing with the state. And i have applied for a job at a hospital. I know they do backround check. Would this affect my background check or since no law was involved it wouldn't really matter???? HELP PLEASE!

We really can't give legal advice-my recommendation is to call a lawyer. Many will do a free initial consultation.
There are also online "ask a lawyer" websites that may be helpful. Just Google "ask a lawyer".

What's there to worry about? If it does it does if it doesn't it doesn't. Either way you can't do anything to change it so why worry?

You said no cops were involved, therefore wouldn't it not be on your record. Call a lawyer and ask

But with employee reference check it might show up. A previous employer can say anything about you as long as its true. Also there's always people know each other and talk unofficially...

I'm curious as to why you would come to a nursing forum and ask (DEMAND an answer, really) a legal question? Why not go to a legal forum?

SYDH all you want, she wasn't asking a question about "her profession" (which this isn't, as she's not a nurse), she was soliciting legal advice, which we cannot provide.
She was given what advice we could provide, which was to contact an attorney.

Call an employment attorney for advice. Yes Walmart can legally notify potential employers that you were terminated for shoplifting (but not prosecuted) since it is the truth.

Negative on both points.
Background checks are not legal. I run them on all my employees.
Various types of background checks can be ran.
