Im really biting my nails about this. A while back i worked for walmart and i was fired for shoplifting. cops were not involved at all they did not press charges they just told me i wouldnt be able to get re hired by any walmart or sams club..I learned my lesson from my mistake it was the first time i had done it and the last time i did it. Now i got my cna diploma im in good standing with the state. And i have applied for a job at a hospital. I know they do backround check. Would this affect my background check or since no law was involved it wouldn't really matter???? HELP PLEASE!

Background checks are not legal. I run them on all my employees.

Pinay, you aren't making much sense: you say that background checks are not legal (and of course they are). Then you say that you run them on your own employees (indicating, naturally, that you break the law frequently, OR that you have no real understanding of what you're doing). Which is it? And, as has been pointed out, the OP is not asking a question "about her profession". She's not asking about CNA work. She's asking a legal question that we cannot answer for her. What was your reason for posting, then, if not to annoy?
OP, whether or not your shoplifting history affects your future employment is NOT a question a forum full of nurses (and in at least one case, NON-nurses) can answer for you. If you have a question about nursing...sure, we'll do our best to help. A question about legal intricacies and your background checks? Ask a lawyer.
It was the screaming that got my attention. Now shoplifting. And the old "hire a lawyer." I doubt the OP can afford to hire a lawyer. And I guess I'd be prepared to answer the question about why I left my last job with something factual and a positive spin. (I did it once, I was young and stupid and I will *never* do such a thing again. Or something similar.)
Sorry Pinay, you are very wrong on that. I know what you are confusing it with, but I honestly can't think of the proper name off the top of my head as to what exactly you are referring to at this moment and time. Long day at school. Certain background check sites especially I think if they include credit scoring with specifically tell you that you cannot use them for job seeking and credit decision purposes.
Ha, it came to me!! You are thinking of websites like instacheck. Consumer websites that people want to check background information on. Like if I was hiring a babysitter or if I wanted to check the background of a guy I just met. They can contain false information. But a criminal background check through a company designed for employers that they pay way more than $1.99 for sure as heck is legal. They obtain their information differently. I certainly hope you are not an HR person running checks on people with consumer websites. That's why they state they are not legal for hiring purposes.
