Allright guys, here is my problem:
My mom works as a CNA?CMA in a nursing home. The nursing home is forcing people to take flu shots this year. My mom has never taken a flu shot, she is just a strong believer in not taking it. She knows that I think this is a stupid attidute, but I also respect her right to say no to the shot.
After about a month of trying to bully people into taking thier flu shots with saying that people won't get their pay check, etc. After a couple of calls to the labor board that got fixed pretty fast.
So here is their new tactict: Call people into their office, physically hold them down, and give them the shot.
Of course my mom is terrified. My advice to her was this: As soon as one of the administrators touches her to try to hold her down I told her to call 911. I told her to be sure to let them know that if they try to physically force her to take the flu shot. If they as much as touch her to try to hold her down to take that damn thing she will call 911 and press assault and battery charges against them. I told her to let them know that they have 3 options:
A: Leave me alone, I'll sign a paper that you offered it and I declined.
B: Fire me and we will take the legal route for wrongfull termination.
C: Touch me, give me the shot and I will call 911 and press charges.
So fire away and give me your opinion. What can she do?
I have been working flu clinics for the las month and a half, and I have been giving them to willing people I can't imagine being the nurse administering a flu shot to someone that does not want it. I'm scare every time I give one that some may have a reaction, and I keep my emergency kit with the ammonia capsule and epi right next to me. The DA does need to step in here and do something. I hope OP gives and update as to what happened I will keep an eye out on the news I'm sure it will make prime time if OP's mother was forced to receive the shot today. Im sure if S*** hit the fan today OP will be busy.
Um. Okay I agree it's assault, but calling 911? It's not an emergency. File charges of course, but don't call 911. That's a little overboard.
Not sure if I agree. If the story is as the OP is saying, someone HOLDING ME DOWN...yeah, I would call 911. What if it were a child, or someone not mentally able physically able to advocate for themselves...like the patients in that facility?
This story does sound far out, however, we can't assure that any story posted here is valid, because most of us do not know each other. We are essentially forced to accept things as face value unless there is a news bulletin or such.
What makes me say that at least some of this is possible is because I have seen nurses do some really vicious things; antagonizing psychotic patients, instigating problems with family members and doing things to each other that are clearly a violation of the person's rights. And, I have seen where administration takes the blind road out. I remember once, a nurse physically abused a doctor, with witnesses, and nothing happened to that nurse. The physician was a really nice person and was horrified when he got no support from the higher ups. Yeah, I can believe almost anything can be possible...:angryfire

Any medical person who gave even one injection this way is out of their ever-lovin' mind! That is assault and battery, and should be a sure-fire way to lose a nursing license!
