Getting off the "do not hire" list?

I'm new here, so hello! ?

I have been trolling for a few days, but had something come up today, so figured I would go ahead and ask.

I have been looking to change jobs, and have been working with a recruiter. I interviewed for a job via the phone the other day, and was told by the recruiter to expect a job offer. The employer is actually through a hospital system that I worked for almost 10 years ago. I didn't even think twice about it, until today when she told me that I was listed as ineligible for rehire. Now, thinking back, I did have some trouble with some allegations people had made against me, and I ended up resigning. So they must have put me on a do not rehire list. The thing is, all they were were allegations. Nothing was ever proven, because, there was nothing to prove. It was all just gossip, and finger pointing. I called the HR dept today to find out what my personnel record states, but I was not able to get any answers. A person in HR said that its sometimes possible to get the status of your eligibility changed, but the HR managers have to review your personnel record first. So as of right now, my job offer is at a stand still because I don't know if this ever happens or not. Has anyone ever had this happen? Where they were on a "do not hire" list, but were able to get it converted back? And if so, how did they do it? I had no idea that I was even on it! And how embarrassing to find out by my recruiter telling me!

When I was laid off due to “structural changes “in the management team based on “reconfiguration” ( their words) by a vindictive boss  after working 11 years with no issues, I was devastated. I was assured by HR that I was able to apply to other jobs within the large health system I worked in. Three months later, no luck on any job. I found out that I was on the do not rehire list.

 I was livid and wrote to the Hospital senior consul an email detailing my work history, lack of issues or disciplines, excellent performance appraisals till the new boss came on board. I stated that I was being retaliated against as I had reported her for favoritism and unsafe practice in the ED. She got her boss, the director to give me a poor evaluation. 

Within 2 days the HR director called and asked me “What is that you want?”

I said, “ I want justice and take me off the list. I want my name to be cleared even if I don’t work there anymore.”

I was planning to take it further if they continued by going to the labor board for unethical practices.

They did.I ended up with a perdiem job there and later on fulltime to date.

The director got fired and was escorted off the premises soon after giving me the evaluation. This was before I got laid off. I honestly don’t know why but I am thinking karma is a b—-*!  A few years after I got laid off ,the manager was told that she could no longer work in ED management and was de promoted to a different location.So justice takes time.

OP , even if you work somewhere else , it is worth clearing your name. Get free advise from lawyers and Google before you do anything. Start with an email. You have nothing to lose.

Not so sure about that. Because of potential defamation an employer would be an idiot to say anything else but the barest minimum without any subjective statements volunteered whatsoever. 

My dad's firm does corporate law but has won several employment related cases in record time he says, by going straight to the insurers and asking what was the motive for the bad reference. He lets the insurers do his work of investigating. It's far more effective than addressing the HR Dept. He says, unless the state or regulatory board has become involved with sanctions etc, no one else stands a chance of malicious intent charges being leveled. The Interview process is the assessment and evaluation potential. 

He's a lazy but wily bugger and you can't argue with him because he'll tie you up in knots. Even my mother who's the real boss, doesn't.

But there are objective things that can be said. Attendance issues are not subjective- either you clocked in and worked or you called off. Medication errors are not subjective. Stupid things like being written up for parking in the wrong parking garage (guilty!) are not subjective. If it's factual, and there's evidence to back it up, there is no such thing as defamation. And anyone stupid enough to fight the truth will have their butt handed to them by the facility's lawyers.

If those are the issues, then you are right.

Accusations can be fabricated, resulting in subsequent termination with no evidence. Generic charges of, for example, "medication error" without specifics have been used to terminate employees.

I was terminated from one facility on generic grounds and when called to cite specifics, my former employer could not produce and I won my case.

the good old dnr list. It's a tactic done to bully nurses. 90% of the time, the abusive system holds no merit.  It's what bitter miserable people do when they hold little significance in life in order to make themselves feel temporarily less insecure.  

 

I've had more than one dnr' temporarily overlooked bc the hospital was so short staffed that they were desperate for nurses. You cant dnr every nurse over trivial power hungry pursuit especially during a pandemic and expect to be fully staffed unless you are paying the highest wages.

My advice would be to reply with, I'm most interested in pursuing this position.  Is there an ETA on the outcome of seeing if I can be hired bc im in the middle of several job negotiations with multiple institutions and it would be unwise to miss out on each opportunity waiting for you guys.. I can hold the others off for about a week. I will reach back out in 48hrs.

DNR ( we call it the do not return) and ? percent done by people who are miserable there was a time when the schedule added me in without knowledge called me after shift started like where are you? And I was like huh she say you are in the schedule and I was like when was it revised this is a new year it’s now past December we are in January 2022 and the changes were not sent to all her problem and still was desperate for float pool and bullied me into no call no show move but when I put my guard up trying same move she told me if I didn’t I would be a DNR and frankly she wasn’t the sweet nice lady more like angry old hag and still think she was personally targeting me for unknown why I never returned assumed I be on that list it’s way so many places and if they bully people it’s quick for me to back away and search for a better fit u know some people are mean
