Exclusion List

So I recently found out that I was placed on the State of Ohio exclusion list. I am not on the federal list just the State of Ohio. It has been 5 years and I was a STNA when this happened and I am now LPN almost done with school for my RN. I was employed and got pulled into the office and terminated because they said I was on this list. I don't know nothing about this or how I even got put on this list. I never received a letter nothing. How do I get my name off this list? Please if anyone can help. I am not able to apply for a job as a nurse in the State of Ohio?

Maybe call the law firm that worked with you previously. I'd be kinda ticked, honestly, if the attorney, who presumably has knowledge of the legal ramifications of whatever you did, did not inform me of the possible inability to work in healthcare in the future.

Wow I didn't know I had to go into detail on why I am on the list. Its obviously something I am ashamed of. I came here for help. Not to be ran further down into the ground because I don't tell my story. I have not slept ate or move for that fact. This is something that happened 5 years ago that I paid alot of money to get resolved. Was never told I was going to be put on a exclusion list. Never even heard of it. I have suffered a great deal of embarrassment as it is to let alone have to go through this all over. My lawyer had my record sealed. Thanks for being supportive and helpful.

Clearly you know why you were placed on the list if you paid a lot of money to get it resolved.

From Ohio Medicaid's website:

"If an individual or company is on the list, the individual or company may not be an owner in whole or in part; officer or partner; authorized agent, associate, manager, or employee of a Medicaid provider."

Most healthcare facilities are Medicaid providers so it sounds unlikely that you will be able to find employment in Ohio, unless it's a facility that only accepts private insurance or private pay patients. Though you may not be excluded in Florida, I would expect potential Florida employers to either ask questions and expect an explanation or balk completely at the idea of hiring someone who has something like this on her record.

Who in the heck are you referring to?!? I saw NO posts that "ran you into the ground" or demanded that you disclose details of your situation. Were there some posts deleted?

I knew that facilities could be excluded from Medicare/Medicaid reimbursement, but I had no idea that a person could be (especially non-providers like nurses who don't personally bill).

Kitty: You should definitely consult your lawyer. Also, I would highly recommend that you use the AllNurses search bar to look up OIG; I'm sure that the vast majority of AN members on the 'General Nursing' forum don't know much about it, but there have definitely been other forums/posts that may answer some of your questions. You could also potentially PM (private message) some of those people who have posted on thos forums in the past, although many of the forums are pretty outdated and the members might not be active any longer. I did a cursory search (out of curiosity), and it sounds like you may have to apply to have your name removed? You could also try posting on the 'Recovery' forum; I have no idea if your scenario was related to drug diversion, but it looks like the majority of the OIG posts are in that forum so you may get more responses from people who actually have experience with the exclusion list.

From what I've read (again, a cursory 5 minute search), it looks like you legally aren't able to work for any facility that receives Medicare/Medicaid in any state (as Kattilac referenced above). It is the employer's job to search the database before hiring you to ensure that you're not on the exclusion list. However, even if a FL employer overlooked the fact that you were on the OH list and offered you a job, it would be a terrible idea to take it until you get this sorted out. Your employer would still be billing Medicare/Medicaid on your behalf, which is illegal (according to the reference that Katillac posted above, anyway).

In the meantime, your best bet might be to work for an employer that doesn't bill Medicare/Medicaid. It may be hard to find, but I believe that one of the OIG forums discussed these jobs:

Have you checked the actual list yourself to see if you're on it? The list does come up on background checks. I know this because I had a background check last week and they sent me a copy of the actual report and the OIG list was on it. Click on the link below and search yourself:

If you are placed on the exclusion list in the State of Ohio not federal can you go to another state and work? Will this show up?

I'm not sure if the search is national. This is the exact wording from my recent background check. They only state "jurisdiction requested" but I'm not sure what that means:

Based on the information provided to us by the client and/or applicant a search was conducted in the jurisdiction requested and no reportable records were found as of this date.

I don't know, but anytime I've had to lay out some hard cash, I always made sure I knew what it was actually for.. Plus kept any pertainant records..

This is what you said in your initial post. You gave us the impression that you did not know why you were put on the list and they did not tell you.
