Hi,
Does anybody know how can I appeal the decision of the board of nursing?
Like everyone else I was also denied by CA BRN. I graduated Bsn in the Philippines last 2008 and I also studied LVN here in CA. I've been working as LVN for awhile now so I thought I won't be denied by the board. But my analyst wants me to graduate from an MSN program which I feel like I'm not yet ready since I don't have any RN experience. I asked her if she can give me any other options such as taking extra subjects to fulfill the requirements but still she wants me to do MSN program. I totally disagree with her decision regarding my application since LVN only needs 30 units to be eligible for RN licensure.
Does anybody know how can I appeal the decision of Calif BRN?

what is the basis of your appeal? if they judged you not concurrent was that in error? why not do the 30 credits and be done with it? if not hire a lawyer for the appeal based on the boards mis judgement.
did you ever send in a copy of your passport?

She denied me due to reason that I wasn't in the Philippines during our commencement ceremony. And she told me that LVN 30 units option won't make me eligible for licensure but It clearly stated to nurse practice act about this option for LVNs like me...
Do I have to hire a lawyer to appeal this decision?
And yeah I sent her the copy of my passport

You certainly can file for an appeal and go thru the process, I know a couple of batchmate's friends have done so, but the decision was the same for both of them, it stands as is.
They had very strong arguments in regards to the concurrency issues, in fact, there's been a couple of good ones posted here and in reading one of their letters, I think it was stronger, but still didn't work. You should still try to go for it, know the possible outcome is not very favorable, but at least you too can say you did it, rather than not doing it. Who knows you might get lucky.
Just go the CA BRN website and there's the information all posted there on how to file for the appeal process. Good luck!
Or another option is to do what this one poster did and she just got her ATT in CA (got their concurrency issues taken care) and there's another poster on this same thread who's friends also got their CA ATT's and all are soon to take the NCLEX-RN:

Steppybay thanks for your response.. Yeah I've been searching on their website but I couldnt find any instructions on how to do an appeal. I emailed my analyst but it seems like she's ignoring me. I also asked for the supervisor's contact info but still no reply.

That does seem to be an odd reason to be denied the ATT for just not being there in the Phils during the commencement ceremony. Was that the only reason stated in your letter of denial?
I can see (from the CA BON eyes) that if your passport shows that you departed the Phils a month (or more) prior to graduation as being suspect, as how could your school grant you the degree if you're missing so much in class and or clinical hours?
Yes, hiring a lawyer is your option, but it's probably not going to be cheap and if you win the case, I don't think the CA BON will be required to repay you or the lawyer back, but you will get the satisfaction of getting what you want.
I just asked my batchmate who had to get the information from her.
