how to appeal on California Board of Nursing Decision?

Does anybody know how can I appeal the decision of the board of nursing?

Like everyone else I was also denied by CA BRN. I graduated Bsn in the Philippines last 2008 and I also studied LVN here in CA. I've been working as LVN for awhile now so I thought I won't be denied by the board. But my analyst wants me to graduate from an MSN program which I feel like I'm not yet ready since I don't have any RN experience. I asked her if she can give me any other options such as taking extra subjects to fulfill the requirements but still she wants me to do MSN program. I totally disagree with her decision regarding my application since LVN only needs 30 units to be eligible for RN licensure.

The graduation Date was April 28 and I departed on Mar 2, 2008 which is two weeks prior to the last week of my school.. School grant me degree coz of good class standing.. But brn denied me for that reason and my point is I also studied LVN here and it said on their regulations that board shall not required more than 30 units of nursing and related sciences to meet the RN requirements

So you missed two weeks of class, in the US there are limits how much you can miss, and I believe 2 weeks is way over the standard.

Ok, I see in your previous comments, that you received the denial letter about 30 days ago. Here's what I just got from my batchmate's friend, who filed her appeal (but lost). It's about the appeal process with the CA BRN.

So you must quickly put your appeal's letter together very soon and file right away or you will lose your rights to a hearing.

Second, so you got denied only for the early departure and not for anything such as the concurrency problems or lacking classes or hours. You might stand a chance to win your case. I would research more into the qualifications of using your LVN courses to meet the RN requirements. I'm wondering if you might have "more" than the 30 units required and they might see that as "excessive".

I recall seeing some PH applicants having that problem and getting denied due to too many hours, I don't know why, but if it's in their policy, then it must be dealt with accordingly.

But make sure your courses ALL of them will pass the concurrency review, as the CA BON can still look further into your case appeal and still find a flaw to cause a denial. Do you know of any batchmates that received their CA ATT's after the application date of Nov. 2011?

It's up to you to present your case in a tight package with no holes in it.

This was his second application, first denied and he went to NM, now he is applying for reciprocity, I do not know if they will look at his current application or old application.

Ahh, okay, I think I see what you're saying, but please correct me if I'm wrong.

The OP already has an RN license from another state and therefore, applying in as an endorsement, doesn't qualify the OP to go and argue using the 30 unit LVN-RN route due to the out of state license.

It would still go back to the difference in the graduation date and leaving the country based on the passport records. Even if his school issued a letter that he was in good standing AND could leave the school/country early, he would still not have the sufficient hours.

Two weeks is approximately 80 hours and yes, that does seem to conflict with minimum required hours or units needed to clear the CA BON requirements.

Thanks for the article. No wonder why California is so hard on Philippine graduates like us. It isn't even our fault. We completed our programs honestly and with integrity. This is just sad.

From an earlier thread, here's another Phils BUM and lowlife, hope all these guys not only get caught but serve some time in the concrete jail house and have to pay a severe monetary penalty, plus lose their RN license FOREVER.

I really do think that this was the start of the looking into the concurrency issue by accident. These lowlifes have been caught with the fake documents and caused the CA BRN investigators to look more closely at the PH transcripts. It's noted on the CA BRN press release that it was back in 2003 that saw the LA nurse with funny stuff.

This is why it's been mentioned since last year that there was a possibility of the CA BRN reviewing ALL Phils nurses transcripts upon their renewal time, this would allow them to look for more possible frauds.

There will be MORE greedy and corrupt PH nurses caught, so even if one is a DON, head nurse, manager and years of excellent service, zero blemish work record, I hope you all know that you have tried to run, but can't hide.

As I mentioned the thread link, I will REPORT anyone I know to the CA BRN Enforcement Division and I don't care who you are! If I know you lied and cheated your way into being a nurse, like I said, in my eyes you're NOT a "nurse", period.

What I mean by these fake documents caused the further examination into the courses not being done concurrently as the CA BRN looked into the regular transcripts and thinking there's possible more frauds but in reality, it's just not being taught concurrently versus an out-right false documentation.

I think the CA BRN has been looking at these transcripts and had these individuals (and many others) under close watch, so it was a way to find a method to stop the flow of more falsified documents coming in, which in essence, hurt all of us more honest and hard working persons and people. Like so many investigations you see, they don't want to alert the bad guys too quickly and can take years to finally come out.

There will be a lot more PH nurses being reported and that's a good thing to weed out these dishonest people. I'd be ashamed to call myself a "nurse" if I was caught.
