Possession charges

Ok. So I self reported to the bon regarding a possesion of a controlled substance a misdemeanor and a felony charge. They sent me back a letter saying I need to send in paperwork of the outcome at court otherwise they close the case after 90 days and may reopen it after I go to court.

I have been arrested for possession charges one I was convicted of this month it was possession of a dangerous drug a class A misdemeanor. I had another charge possession of a prohibited substance in a correctional facility a felony that charge was dismissed completely but apparently still appears on my background check. I had another interview on Monday they said they were going to hire me and told me to be at orientation this Wednesday but called me and told me they'd decided not to pursue my application... When I asked them why she got rude and replied because we just decided not to pursue it. I am devastated. I was so excited to have a job again it's been about 7 months now since I've had a job. I feel like giving up. I know I am so much better than the mistake I made! I am a good nurse with no drug habit. I'm not addicted to anything heck I don't even like to drink because it makes me feel weird. I am not this horrible person that deserves unemployment because of one horrible mistake. Any words of encouragement?

My lawyers have said it can take up to a year to go to court. I was going to enroll into tpapn but I have been unemployed ever since I got the charges. I walked away from my job at the time because I was scared they would think I was an addict or unfit to work. My question is is it ok to work now until I go to court or is it going to be impossible with these pending charges?

Time without any charges, time in a monitoring program. If I had a time machine ( which I don't ), I see you being referred for an evaluation, advised to seek treatment and then completing a contract in your State's monitoring program.

Other nurses who have been caught 'diverting' ( stealing, basically ) but weren't arrested, haven't been caught up with by their boards yet, etc... are free to go get another job. Because you were arrested and charged ( depending on the facility, they can hold arrests with NO charges against you too, they just never tell you that ), they already know.

Hunker down, get a job slinging hash and wait for the board to contact you. I wish you had the option to self report to a monitoring program first, instead of just going straight to the board. Was that option not presented to you? I do remember you saying something about TPAN, but was that after you had already reported yourself to the TBON?

I would try applying at places that would be monitor friendly once you have to go down that path. Try dialysis or case management or psyc. It might not be something you want to do but at least you have a job and they would more likely keep you because they can handle your monitoring restrictions. Good luck and don't give up.

If you check BON it ll tell you what the status of your license is and at least you ll have an idea of whether you have a pending investigation. I would make moves like enrolling in a program so that when BON does come to you, you can show them that you are making progress without being instructed to do so.

I got great news the board of nursing closed the investigation with NO action taken against my license! I am still having the hardest time finding a job with this charge on my background though. I have been to several interviews and explained that the bon has taken no action against my license and they still opted not to hire me... It's very discouraging. í ½í¸”

Try going to the places where monitored persons have found work, such as dialysis. Since the Board did nothing to you, you should be able to get work. After a time, other employers should be more open to putting this behind you too. And congratulations on going through Board review and coming out unscathed. Too bad you can't make the whole nightmare disappear.

My guess is it's because the charges are so recent. We handle narcotics, a recent misdemeanor conviction for drugs would make me a little nervous as a potential employer. I would be happy as hell if I'd escaped without a monitoring contract, but my prospective employers might not. I am in no way giving legal/life changing advice. But nurses I have known with very recent arrests for diverting, etc... were more appealing to an employer with a monitoring contract and random drug screening. Make a "Poll" on one of the career threads and see how potential supervisors would feel about hiring a nurse with a recent drug conviction and no monitoring contract. That it's a misdemeanor is irrelevant.

You could try applying for drug treatment centers, but they are also going to want to know what you're doing to protect yourself and them from potential problems.

I went for a job interview and was upfront about my charges and was told that they wanted to hire me but had to wait for mg background check because certain things are bearable from working in nursing homes but she wasn't sure if that offense was or was not barrable. I won't know until my background check comes in and I'm a nervous wreck. I really need a job. Does anyone know if this offense is barrable?

You can check to see if you are on the OIG exclusion list Search the Exclusions Database | Office of Inspector General has a simple look-up. If your conviction qualifies to exclude you from facilities that receive medicare/Medicaid payment you will be on this list. You can apply to have your name removed.
