I am starting a new thread to track cases from NVC - embassy to GC.

The best news for RN in China, Phillippines and India has been great and informative thread, but I think it is more appropriate and convenient if we start a new thread.

Also with the rapid scheduling of interviews for most of us, I am looking beyond the CP and anticipating the GC!

The August interview schedules are out already in India, and recently in the Philippines and hopefully in China.

Here is my case details

Category : EX Schedule A

USCIS receipt : April 2004

Processing Center : Vermont

I-140 approved : October 2004

NVC case number : MNL2004813XXX

NVC forwarded packet 3 : April 5, 2005

Packet 3 sent back to NVC : May 3, 2005

NVC case completed : May 16, 2005

Consular Interview : August 29, 2005

Visa received : ???

Date of entry in the US :???

GC receive : ????

You never send in anything unless the US government specifically asks for it; they will not accept it otherwise.

No one has any idea as to what is going to happen in October and what PD date that they will be looking at. It means two more months of waiting until the October Bulletin comes out in September.

I need an opinion on this: the hospital that sponsored us in the US has backed out and refuses to give us a current job offer.. If we transfer to another agency or hospital , we need the "release" papers right? and if indeed this new hospital "buys" me out of the old one, do I keep my Priority Date? Opinion Please........ help....

Suzanne would be the best to answer your concern but will chime in a few comments.

If your original petitioner backs out on their own, I do not see why someone needs to buy out your contract.

If the hospital backs out of the contract and no longer has a job for you, your file gets cancelled with immigration. It can never be transferred and you will lose your PD date. No current job offer and therefore they back out of the petitioning process as well. There are no release papers that are needed to be given to a new employer, there is no longer any contract that exists if no job is available.

And we have seen this happen before, and one then starts all over again. Silverdragon102 (Anna) actually had this happen to her and she had to start over from the beginning with a new employer as if nothing was ever done and start from the beginning with a new PD date as well.

This is why it is so important when signing a contract to know that things can change and even with waiting, there are not always jobs at the end of the line and things can get cancelled.

There is nothing to buy out as there is no petition any longer if there is no job. You cannot just have a new employer assume the other contract, it is not permitted to be done.

i second the motion. I had a friend whom i know when we took the NCLEX exam (saipan). His emplyer backed-out and his PD was Decemebr 2004. He was suppose to be interview why back ahead of us. But when he tried to follow up his docs from his agency, the agency said that they cannot process the embassy interview any longer bcoz the employer alrready pull out the job order. He has to start from the end of the line with the new employer. but he didnt continue with the new application... Now he's in Dubai taking his scond option, to work in Dubai for the mean time. This is really so sad for us applicants. This is really unfair, 'coz if we are going to back out from our agency we are liable for breach of contract but if the employer back out they only send us our docs back and no any other hard punishment for them. right?

This is why it is so important to know exactly what is going on with the agency and if they will have work for you. Agencies work in several fashions, as well as even direct employer hospitals. And administations do change and management as well, this is not something new at all. And has gone on for quite sometime, and with the retrogression in place, hospitals are not always going to wish to wait for someone. And companies get sold or go out of business all of the time, including hospitals.

They are not breaching a contract, they do not have work for you; and the US will not issue a visa to anyone if the work is not guaranteed. Not sure how you think that they should be punished, or even why? They only get paid if the nurse begins to work, so any money that they have spent on you is lost to them, as well as time invested.

This just backs up even more what we have been saying all along, do not just sign with the first company that will take you, there is much more that one needs to be aware of, and the fact that just because you sign something, it is not a guarantee that you will get to that country, whether the US or another. And with more and more applicants, the number of visas still has not increased in any country, actually they have gone down. So you will be seeing more and more of this as well.

Let's be busy and pray that in two months time or less, we'll have our visa:yeah:...by the way I have a friend with pd of dec 2005 and case completed again last may 15 I guess, she just received an email from NVC I think, stating that she has to wait 45-90 days for the letter(thats maybe end of aug or sept).maybe that's due to unavailability of visa for now...so probably we'll just have to wait til oct..God bless everyone..

Hi dewko, do you know what letter they are referring to? Is it the appointment letter or another letter requesting to send again updated DS 230 and docs? I have a PD of Nov 2005 and case completion of May 14 though I have not emailed NVC.

Hi everybody, my PD is September 2007, I can see that I have a long line to wait for, but I am still full of hope for this October, or may be a hope for a miracle to happened for all of us :)
