I am starting a new thread to track cases from NVC - embassy to GC.
The best news for RN in China, Phillippines and India has been great and informative thread, but I think it is more appropriate and convenient if we start a new thread.
Also with the rapid scheduling of interviews for most of us, I am looking beyond the CP and anticipating the GC!
The August interview schedules are out already in India, and recently in the Philippines and hopefully in China.

anyone want to comment on this?if an applicant is reported documentarily qualified but allocation of a visa
number is not possible because of a visa availability cut-off date, the demand
is recorded at the visa office and an allocation is made as soon as the
applicable cut-off date advances beyond the applicant's priority date. there
is no need for such applicant to be reported a second time.
visa numbers are always allotted for all documentarily qualified applicants
with a priority date before the relevant cut-off date, as long as the case had
been reported to the visa office in time to be included in the monthly
calculation of visa availability. failure of visa number receipt by the
overseas processing office could mean that the request was not dispatched in
time to reach the visa office for the monthly allocation cycle, or that
information on the request was incomplete or inaccurate (e.g., incorrect
priority date).

most of us were declared documentarily qualified last year per email received from nvc, email received aug. 8, 2007
dear madam,
your inquiry has been received at the national visa center (nvc).
the applicant's name has been placed on the list of documentarily
qualified cases awaiting the availability of visa numbers under the
numerical limitations prescribed by statute. the designated
representative of this case (applicant, petitioner, or attorney) will
be
notified of an appointment date as soon as the numbers have been
received. the applicant should not make any travel arrangements, sell
property, or give up employment until the us embassy or consulate
general has issued a visa.
an immigrant visa is usually valid for six months from the date it is
issued. it may be used to apply for admission into the united states
any
time during its validity.

now based on the above testimony, we do not have to be declared documentarily qualified
for the second time this year (case completed may 14, 2007 pd nov 2005).
if we they follow what they stated, then they should have alloted a visa number for us last may 2008
when our pd became current, right? so how come we are stil affected by the july 2008 retrogression and have to wait for
fiscal year 2009?
any comment guys? does this mean that nvc messed up last year and failed to report our cases to the visa office.
they had almost a year to report us as documentarily qualified to the visa office and we should have been allocated a visa
number already when our pd became current last may.

my case was completed april 24, it will be the 8th week of next week. i emailed nvc last june 6 and received the same email as yours. so right now i am assuming that they have not reserved a visa for me. though i am still hoping i am wrong.... i just hope as a consolation, come oct. when dates return to june vb they will not have to ask the same docs.... i was really fast this time in getting my docs updated but still didn't make it. its really frustrating how things go.
No one messed up last year, there was a retrogression going on. And remember that there are still more applicants that are waiting than the number of visas that are issued per year. At this point in time, just because a PD becomes current, it does not mean that a visa number is available for you.
And PD dates that are current now, were not current last year. Informaion that is in a file can need updating from time to time, but that still has nothing to do with a PD date being current. PD dates just became current for the 2005/2006 times in the past few months.

already receive his visa:yeah:..He had his interview last sept 06,2007 under EB3..

Glad to hear, thanks for letting me know.
And for others reading this, this poster's husband already had his interview months ago and still needed to wait for a visa, but it was under different circumstances than most of you.
In normal situations, you will not even get an interview scheduled without a visa being available to begin with.
hello.. my pd is march 2006... my friend is tempting me to sign out my immigrant visa and apply for an H1b visa. Is this true that nurses is qualified for this H1B? I talked with my agency about this but they said that this H1B visa is not applicable to nurses. I am really tempted to go to working visa and adjust my status there as an immigrant when the visas become available. Its just the same thing i'll still be working in america whether as an immigrant or a temporary visa. need advice here friends...

If you have a bachelor's and highly skilled in an area and the hospital does H1b then you could apply for it but it isn't something that can be classed as a quick fix. Most H1b's nurses are not qualified for and most hospitals do not do and you apply in April with a start date of Oct if you are lucky as very much a lottery with a high demand with very few visas. Visas are usually exhausted within hours of release

Dear fruity & topscot,
It's been 8 wks for both of you since case completion & as per NVC, they're supposed to give us update after such time. Have you tried giving them a ring? Or e-mail? What have they got to say? We're hoping that at least completed cases be forwarded to respective embassies (considering that the July VB stated that PDs will revert back to what it was in June come Oct). Thanks!

Sorry, but there is a significant difference in working in the US with a temporary visa or as a permanent resident. Also be aware that the temporary visa can be cancelled at any time and you would then have 30 days to leave the country; and nothing to do to change that.
There are no visas available at this time, so there is no way to come here and expect to be able to adjust your visa. Just not going to happen at all.
