I am starting a new thread to track cases from NVC - embassy to GC.
The best news for RN in China, Phillippines and India has been great and informative thread, but I think it is more appropriate and convenient if we start a new thread.
Also with the rapid scheduling of interviews for most of us, I am looking beyond the CP and anticipating the GC!
The August interview schedules are out already in India, and recently in the Philippines and hopefully in China.
Here is my case details

It does not need to be buried if you truly understand how things work. As long as a number has been assigned to someone, then things will proceed for them.
However, if a number has not been assigned as of yet, then they are looking at the next fiscal year which starts on October 1, so the Bulletin will be up for viewing mid-September.
And none of this is new information, word was already out that this is what was going to be happening per the previous Visa Bulletin. And this does not spare those from different countries, all are still affected as there are no more visa numbers to be assigned at this time.

Hope you can help me understand more... in which process does a VISA NUMBER being assigned to you? In which you are sure already that there alotted for you? As soon as your PD becomes current? As soon as you are Case complete? or only when you are given a schedule for interview? thanks a lot. this forum is really helpful...

just wanna share the email that i received from my lawyer. i am just wondering why the nvc is now setting a deadline. for what? there's no visa available right?

if indeed your lawyer received a notice of such thing from the nvc then it maybe because for all intents and purposes things will only cease starting july 1.
the july vb only starts on july 1. we are still in june and so pds before march 1, 2006 are still current and all cases asked by nvc for updates (up to nov. 2006) will still be accepted and processed within this month. starting july 1 when eb3 becomes unavailable, everything stops.
it is up to you if you want to send them your docs or not if you feel it wouldn't matter now and then just do it in oct.

if an applicant is reported documentarily qualified but allocation of a visa
number is not possible because of a visa availability cut-off date, the demand
is recorded at the visa office and an allocation is made as soon as the
applicable cut-off date advances beyond the applicant's priority date. there
is no need for such applicant to be reported a second time.
visa numbers are always allotted for all documentarily qualified applicants
with a priority date before the relevant cut-off date, as long as the case had
been reported to the visa office in time to be included in the monthly
calculation of visa availability. failure of visa number receipt by the
overseas processing office could mean that the request was not dispatched in
time to reach the visa office for the monthly allocation cycle, or that
information on the request was incomplete or inaccurate (e.g., incorrect
priority date).

most of us were declared documentarily qualified last year per email received from nvc, email received aug. 8, 2007
dear madam,
your inquiry has been received at the national visa center (nvc).
the applicant's name has been placed on the list of documentarily
qualified cases awaiting the availability of visa numbers under the
numerical limitations prescribed by statute. the designated
representative of this case (applicant, petitioner, or attorney) will
be
notified of an appointment date as soon as the numbers have been
received. the applicant should not make any travel arrangements, sell
property, or give up employment until the us embassy or consulate
general has issued a visa.
an immigrant visa is usually valid for six months from the date it is
issued. it may be used to apply for admission into the united states
any
time during its validity.

now based on the above testimony, we do not have to be declared documentarily qualified
for the second time this year (case completed may 14, 2007 pd nov 2005).
if we they follow what they stated, then they should have alloted a visa number for us last may 2008
when our pd became current, right? so how come we are stil affected by the july 2008 retrogression and have to wait for
fiscal year 2009?
any comment guys? does this mean that nvc messed up last year and failed to report our cases to the visa office.
they had almost a year to report us as documentarily qualified to the visa office and we should have been allocated a visa
number already when our pd became current last may.

Life's like that I mean it's really frustrating but cheer up we have never see the Philippine's eb3 row. In Mumbai it's generally unavailable. Hope that Philippines will be spared.
