I am starting a new thread to track cases from NVC - embassy to GC.
The best news for RN in China, Phillippines and India has been great and informative thread, but I think it is more appropriate and convenient if we start a new thread.
Also with the rapid scheduling of interviews for most of us, I am looking beyond the CP and anticipating the GC!
The August interview schedules are out already in India, and recently in the Philippines and hopefully in China.

Hi Mariel,I was not scheduled for interview... they replied my email inquiries just last June 16 and 18, still the same message. I guess they will not forward your papers to US embassy until you are scheduled for an interview. I just hope come Oct I won't have to repeat packet 3 again.

Fruity, thanks for the quick reply! Since nothing's certain, let's just prepare everything again ( ds230s, pics, police clearances etc). We've gone this far & we shouldn't leave any lil bit of anything out to chance.
On another note, I've heard about one Nurse w/ PD Nov2005 who had her interview last wk (she's Filipina in the midEast) & wasn't issued a visa bec. consul also asked for cgfns cert whilst we know Visa Screen is what's usu. asked for...you never really know.

It's probably the Visa Screen Certificate. Many people still mistake one from the other and then pass it along and then it becomes a rumor.
Proof of passing the CGFNS exam (part of the CGFNS Certification) and/or proof of passing NCLEX is a requirement from the start. An I-140 (the job petition) will not be approved by USCIS w/o any of those.

Are you absolutely sure that passing of NCLEX is required for approval of I-140? I personally know lots of nurses who are already in the US whose I-140 were approved eventhough they have not passed the NCLEX. But they were informed they have to pass it before their consular interview.

I can't believe we have to do all things again after 3 months. Everytime the NVC asks for new set of documents I have to set aside $50 for fedex fees (lawyer-NVC) and roughly $30 fedex fee(manila-lawyer). plus I had to take 2 days leave from work just to process all those docs. I don't understand why will they have to ask it again if its only been 3-4 months:(

Passing of either the CGFNS exam or the NCLEX-RN exam is required before the I-140 can even be submitted. Forget about it just being needed for the Consular Interview, they cannot even get a job offered to them legally in the US without having one of those exams passed.
If they have not taken one of the exams, and it was submitted that they did, it would still be impossible for them to get anything done or approved as actual proof from the BON has to be submitted by the attorney.
Without one of those exams being written, they are just telling you something that just does not exist. And not sure how you know many that are in the US now and are waiting, we have a retrogression in place, so that means that they are doing something illegal to be here as well at this time.

Sorry for not making my post not very clear and complete. I should have written that they are already in the US as LPRs and passed both CGFNS and NCLEX before they had their embassy interview and their visas issued. It is only that their I-140 were approved even with only the CGFNS passed and even before they had sit and passed the NCLEX.
I am not pertaining about the issue whether CGFNS and/or NCLEX are needed for the embassy interview or particularly on the issuance of the visa because I know both are required. I am clarifying only on the issue that even if NCLEX has not yet been taken and passed the I-140 can still be approved.
The I-140 can only be submitted if they had taken and passed the CGFNS exam. That has been done for years, and the NCLEX exam is not actually even required for the Embassy interview. All that is required is that either the CGFNS or the NCLEX-RN exam be written and passed and that is actually a requirement before the employer can even offer a job to them.
What we have been saying all along and what you are not understanding is that the NCLEX is not a requirement as long as the CGFNS exam has been written and passed. And this is how things always have been. Nothing new.
The fact remains that the attorney cannot even submit the petitions until at least one of the exams is passed. That is all that we are trying to get you to understand and you have just posted what we have been saying.
For years, the NCLEX exam was not given overseas and all that was even available was the CGFNS exam. By federal law in the US, an employer cannot even offer a job without one of these two exams being passed.

Which part of my post did I say that an I-140 cannot be approved w/o the NCLEX ?? I said the I-140 has to have proof of passing the CGFNS exam and/or NCLEX. You misunderstood my post. Hope that this clarifies everything now.
