NVC -CP- GC Tracker

I am starting a new thread to track cases from NVC - embassy to GC.

The best news for RN in China, Phillippines and India has been great and informative thread, but I think it is more appropriate and convenient if we start a new thread.

Also with the rapid scheduling of interviews for most of us, I am looking beyond the CP and anticipating the GC!

The August interview schedules are out already in India, and recently in the Philippines and hopefully in China.

Here is my case details

Category : EX Schedule A

USCIS receipt : April 2004

Processing Center : Vermont

I-140 approved : October 2004

NVC case number : MNL2004813XXX

NVC forwarded packet 3 : April 5, 2005

Packet 3 sent back to NVC : May 3, 2005

NVC case completed : May 16, 2005

Consular Interview : August 29, 2005

Visa received : ???

Date of entry in the US :???

GC receive : ????

each country gets a certain amount of visas allocated each quarter. If there are spare visas then you will get one allocated. Demand where visas are high will obviously have a harder time than where the demand is low

More importantly, the country wheren the nurse is from. There are a number of visas allotted for each country, and depending on how many are in line from that country for a visa also can make changes as to when the visas are available for those from your country.

Nurses from smaller countries where many do not plan to immigrate to the US will get visas first. That is just the way that things are at the moment.

With any from countries where there is a large number waiting, there are not going to be visas for months at the very least. Then they also go to the ones that actually have a completed file, as that is when the visa number is reserved, not when they get approval on the I-140. But when the DS-230 has been approved and accepted and the file sent onto the NVC.

I was also thrilled to see that somebody gets packet 4. Their country of birth is Russia, actually - the country which even does not participate in Greencard lottery! What do you make of the fact that both wife and husband in the couple who received it are nurses (I have spoken to them)? Do you think it promotes their case in front of others?

Also, is here anybody originally from Ukraine who also received packet 4?

If a nurse has some dependent included in the application for GC, will the employer pay the IV fee bill for the nurse including his/her dependent? Can NVC process the nurse application first then process the dependents later?

If the nurse fee is already paid and the dependents are not,will NVC still process the application to the next stage or have to wait till the IV fee bill of all the dependents are paid?

Does not promote them in front of others, actually only one gets petitioned, the other goes as the spouse. There are actually many couples that are nurses from all over the world.

The issue is that visas were not used up for the EB-3 category for them. That simple. And also when there file is actually completed, I trust that more than the PD date. I have seen quite a few with PD dates from several years ago that are still waiting, as their file has never been completed. A visa number will not be assigned until that time.

The employer does not usually pay the fee for the dependents, the nurse needs to. As long as the fee is paid for the nurse, USCIS will continue to process that petition. As long as the dependents are included on the DS-230, then the fee can be paid later for them. If they are not on the DS-230 when it is submitted, then they will be waiting two years minimum.

Everything will progress up until packet 4, or the US Embassy interview, and medical. Provided that each step is completed properly and USCIS does not need to ask for additional information.

Until there are visas available for those from your country, you will be in a waiting pattern.

I tried to contact my lawyer but she told me that NVC will hold my file until it is time to immigrate. Then NVC will request the immigrant visa fee and I will be scheduled in Manila. No need to contact NVC unless my priority date is before 8/1/2002. But based on what i read here, it is possible to process my papers until DS230 approval. I was wondering how much would be a visa fee and would it make any difference if i would pay it myself if my employer dont wana pay for it now? or should i wait for my employer to pay for it when the retrogresion is lifted ( which is unpredictable). Hope to hear a response. Thanks and morepower.

the fee should be paid on request and will go to your lawyer, you could ask them about you paying for it. Your papers are processed until packet 3 so think your lawyer is either playing lazy or your employer has requested the wait.
