I am starting a new thread to track cases from NVC - embassy to GC.

The best news for RN in China, Phillippines and India has been great and informative thread, but I think it is more appropriate and convenient if we start a new thread.

Also with the rapid scheduling of interviews for most of us, I am looking beyond the CP and anticipating the GC!

The August interview schedules are out already in India, and recently in the Philippines and hopefully in China.

Here is my case details

Category : EX Schedule A

USCIS receipt : April 2004

Processing Center : Vermont

I-140 approved : October 2004

NVC case number : MNL2004813XXX

NVC forwarded packet 3 : April 5, 2005

Packet 3 sent back to NVC : May 3, 2005

NVC case completed : May 16, 2005

Consular Interview : August 29, 2005

Visa received : ???

Date of entry in the US :???

GC receive : ????

Hi, February '07 VISA Bulletin is posted already. There are 50,000 recaptured visas for Shedule As again? what does this mean, retrogression is lifted now?

all I can see is that Schedule A workers are entitled up to the 50,000 recaptured visas but they have all gone. Not sure what to look under re nurses

The 50,000 were the ones that have been used, no new ones have been allotted.

If you look specifically at the chart for February, 2007: You will see that Schedule A has been removed, as was stated in the last bulletin that it would no longer be available. There is no actual listing of Schedule A, as there has been in the past.

Nurses (RNs only) are classified under the third category. They are listed as requiring a PD of before 2002 in most cases. But, they are now permitting you to adjust a former PD that was submitted on your behalf,if you had one, so that the date from then can be used for you. In the past, this was not permitted.

Please also note that with a significant specialized and needed work history, Master's degree, or PhD, or having received special honors in your country for your nursing contribution; you may be able to qualify to be included under the EB-2 category and this is current for many areas.

(This would move you to second preference from the third.)

January 8, 2007. I e-mail NVC and after 2 days they send me these...

This petition is not yet eligible for further processing. The petition will be retained at the NVC until a visa number is available. The petitioner, beneficiary, or attorney of record will be notified when further consideration can be given to processing this petition.

How long before i can receive a DS-230 forms (with BAR-CODE) ??

Will the NVC send it to me or to my Petitioner ??

Nothing stops for you at this point, DS-230 forms are still being processed. The DS-230 is sent to who paid the bill. Then it will be forwarded on to you. That step will continue, but nothing past the approval of the DS-230, no medical and no interview date until there are visas available.

1. the nvc will not accept anything directly from the applicant. you have to send all to us to submit for on your behalf, since we are the attorney for the petitioner.

2. with retrogression, the nvc is not accepting any documentation at all.

please sign the ds-230 form , so when the nvc begins processing the paperwork i can overnight it to them immediately.

If the nurse is not in the US, they are accepting the DS-230, and things can continue to get processed up until the time of the medicals and the US Embassy interview.

If in the US, only the I-140 can be submitted as the other petitions for the AOS are on hold.

The issue that many are coming across is that the visa bill needs to be paid before the DS-230 will be sent out, and many employers do not want to do this until they know that things have opened up, but the attorney is giving you inaccurate information based on what the employer wants, not what immigration is doing.

There is nothing new that has not been discussed already. And yes, anything will benefit those of you that are waiting as visas will go out first to those with the longest waiting PD with completed files.

Remember that if your file it not complete, then you are not in-line for a visa, even if your PD date is a couple of years old.
