Legal ramifications at facility

We use Dakins solution in wound care where I work. Recently the facility has started " making" their own and refilling the bottles with a label stating made on xx date. Is this dispensing without license? Two lens are making it. I know it's probably illegal to refill a bottle but what are the other ramifications??

First of all, what type of facility is this? If it's an acute care hospital, the onsite director of pharmacy is permitted to mix the solution and/or direct certified pharmacy technicians to prepare the solution.

If this is a nursing home or LTC facility, members of staff can prepare Dakin's solution under a physician's order or a pharmacist's directive. It's an OTC preparation with a 'recipe' that can be found easily on the world wide web.

Pharmacists make stuff all of the time. They often make compounds and solutions. Some meds have to be mixed at the time of fill. Not everything comes prepared all ready to dispense. I worked as a pharmacy tech for several years. Anywhere I worked the only thing techs could do would be add water to certain antibiotics. Pharmacists had to do all of the mixing and measuring of everything else. Like magic mouthwash and certain GI meds had to be mixed by the pharmacists. They also make certain creams.

I don't believe you are "dispensing" unless it leaves the facility.

Sorry. 2 lpn's..not lens..im sure the medical director would back them. I've just never worked where this was done. The facility is an LTAC.
