Failed Drug Test!!!!!!

I went last week to take a Drug test to start my program next week. I have migraines/Tension headaches which I generally take Excedrin for, but sometimes its not enough. The Dr. prescribes a very weak dosage of Esgic plus for those times. The day before the drug test was one of those headache days. Anyway, when I went in I took the prescription bottle with me to show them. The man doing the test said he couldn't look at it or make note of it because of hippa laws which are there to protect my privacy.

Last night about 5:30 pm I am coming in from a very stressful, long day and guess what was on my answering machine. A message from someone at the drug testing company stating their was a problem with my drug test and to call them. By the time I got home my TEENAGERS had already heard the message, and wanted to know why I had failed my drug test, and what drugs I was doing. To make matters even worse my parents were there too wanted to know the exact same thing.

I call the guy, and he informs me that my prescription Esgic plus was found, and I say "Yes, I have a prescription for that". He told me to rip of the label for the medication, and fax it to him. I don't have a fax at home, and by the time the local fax place was already closed.

Today I went to the fax place to fax, and when I got back the Dean of the nursing program had called. He leaves a message stating that he had word that my drug test had come back +, and wanted to get a report from me.

I called him and left a message, and called his secretary and explained everything. They were not made aware that it was a prescription drug, and that I was faxing in proof. I called the drug testing place back, and they said the fax was received, and they would verify it with the

pharmacy then they would change my test results to -, and all would be fine.

So here I am with a days worth of phone calls, frustration, and the added gasoline, and fax expense. More important how did this protect my privacy? My whole family was basically informed that I failed a drug test, but not given the details why. Would it not have been easier, cheaper, kinder, less frustrating, and protected my privacy a LOT more if they would have just made note of this when I took the test.

I don't want to make a big deal of this with my new professors, dean or fellow students. I also don't want to call up the drug testing place and vent after all they have my urine (and future) in their hands. I just needed to vent. Its the very beginning and this had left a VERY bad taste in my mouth.

This is just about the biggest waste of time and money I have ever seen. If you told the person about the medication why in the world didn't they just go ahead and record it and send it in with the test. Good grief. Life has really gotten difficult to manuever. I used to administer drug tests to potential employees, if they were taking anything that would make the test positive, we would copy it and send the copy in with the test.

Okay here is the thing. If you volunteer the information yourself to the guy in person that is NOT a violation of HIPPA. It IS however a violation for him to request that information over fax since God only knows who is receiving it on the other end. How dare they... I'm sorry you went through that. :(

I don't understand why you couldn't just go to local place where you were tested. Why couldn't they give the other place a call to confirm that yu did bring proof in. That was totally ridiculous!! At the very least, they need to send letters of apology and explanation of their big goof. HIPPA violation for him not to see your lable. BS!! Yeah, and the brainy people leave a detailed message on your machine?? That really makes me mad!

I think people need to be on the same page about HIPPA. I was outraged when I read on the front page about a guy who attempted suicide. They talked about he served in Iraq twice, and how he surprised his children at elementary school with visit. Then they go and say he left the house with guns and had attempted suicide. His name, address and age were listed. The police had brought him into the ER. How could they have ever printed that story with his name?

Too many violations with this...first, he never should have left private info concerning your test on an answering machine !!!! He also should not have requested you fax the label from your medication to him...He should have taken down all this info when you went for your test...I would have to raise hell with someone over this...Supervisor of lab??? or whoever is manage of dept. that called and left message...

I don't know where you live, or the HIPPA guidelines where you are, but in my state, that would be a violation of your rights.

How would you, the patient, providing your OWN information willingly, be violating HIPPA??:no:

You, as the patient, are the ONLY one who can give out information with no concerns over HIPPA violations. Using that scenario patients can't give their information to anyone. That is not a HIPPA violation.

What the company does with that information, provided by the patient, is controlled by HIPPA. Leaving the message did violate HIPPA

YOU offering YOUR prescription information prior to a drug test IS NOT a violation of HIPAA.

The lab leaving details of your results on your answering machine definitely is a HIPAA violation. Your children and parents ought not have caught wind of any of this. That is a definite violation of your privacy.

I would definitely be calling that lab to raise some hell.

Dear Lord...that's awful. The man should have written the info down and all this would have been avoided. That is not a HIPAA violation as you bought the prescription info with you.

Leaving a message that you failed a drug test IS a HIPAA violation. I would be raising holy hell over that one. I wouldn't want anyone to lose their jobs but they need to be told NEVER to do this again. What is wrong with them?! Dear Lord.

I thought before all drug tests they are supposed to provide you with a chance to state all the meds you've taken recently/have Rx'd?

Thanks to all for the validation of my feelings. There were 40 of us so I am sure others had to go through the same thing. I just felt really violated, and angry. At the same time I don't want to rock the boat before I am even on it.

It really did create problems. I have a teenager who is a recovering drug addict/alcoholic. For this reason we do not have ANY alcohol in the house EVER. In addition, we do not keep any form of narcotics, cough syrups etc in the house. I had to think long, and hard before excepting that prescription for migraines. Even though its an extremely low dose of bubarbital its still bubartital, and I didn't want my son to know anything like that was in the house. He is has been sober now for over a year, but it was a very long road that really disrupted the entire family, and I wasn't sure we would ever be able to get to this point. When everyone heard that I failed they wanted to know why. It was either tell them the truth (show them the prescription), or let them think that I am doing some kind of street drug or lying. Now he knows there are narcotics in the house so I had to flush them. So when I get the next migraine I will just have to stay in bed, miss school, and suffer through it.

P.S. I had to use the label because I had to get the info to them ASAP so I could start school, and didn't have time to leave a message for the Dr., wait for a return call, wait for them to write a letter, pick it up, etc. In addition, it had to be faxed and could not be scaned and emailed. Even though the place I went for the test was local the people who called and wanted the information were in a different state so I couldn't take it to them.

I have suffered from migraines since I was 13. I have been to several "headache clinics" where I was a pt. for a month at a time, done bio-feedback, been on more meds than I can remember (my freshman year in college I was on Sansert, Inderol, Halcion, and Thorazine, because my Neuro thought maybe this was the right combo-no wonder I failed that semester!!)

What changed my life about 10 years ago is IMITREX!!! I swear by it. I use IM or PO. Depending on the severity. Give it a try-lot of new migraine meds on the market that are similiar.

Sorry for what you went through. If it were me, heads would roll. Look at the ramifications this HIPAA violation has caused!

Clearly this operation is run by idiots. If this was a lab doing tox screens for employment/school physicals, you should have been given an opportunity to list any meds. He was being lazy by not taking your info, not to mention stupid. This also goes to show how many peole misunderstand HIPPA, especially medical folk. Call the director of the lab immediately, and I would look into your state's cabinet for health and human services and report your HIPPA violation (the message left on the machine). You have to pick your battles, but if you are up for it- this may be worth it. Good luck!!

This was my first drug screening, and I was surprised by a lot of things. I was told that when you had a drug test someone went into the bathroom with you to watch you pee, and make sure you didn't do anything sneeky. I was all freaked out about this because as you know we women aren't at are best when TRYING to pee in a small cup.

Anyway, when I got there I signed the consent first. Then I tried to show him the two prescriptions that I take which I physically brought with me (Esgic plus, and Yasmin birth control), and have him note in on my paperwork. He flat out said he could not look at it, or take note off it because it was a violation of the HIPAA law, and my privacy.

He then gave me a cup, and said pick bathroom A or B, urinate in the cup, and do not flush. I chose B because it was nearest. It was a small room with a toilet, and a door that locked. I went in by myself without having any kind of search to see if I had anything on me (chemicals, extra urine etc). I pee'd in the cup, came out, and he had a paper towel on his desk that he told me to sit it on. Then he told me I could flush, and wash my hands. He never got up from his desk, and no one else checked the toilet before I flushed so I don't understand why they make you wait. Then he told me I could leave.

I thought it was all very strange. Personally I don't see how it could be a Hipaa violation if I am giving it to him, and it would have saved so much time and trouble for everyone if they just had that information to start with. Plus how do they know you don't cheat if no one goes in the bathroom with you or checks the toilet before you flush?

Is this a similar experience for everyone else.

Oh Coolpeach! How is it going otherwise? Sorry for the hassle, headache (in all manners!) and violation of your privacy. When things settle down, definitely call and report the violation.

When I had the drug screen for my nursing school a couple of months ago they sent me and the school someone else's drug screen results! No one but me caught it. Fortunately, we were both negative and it was easy enough to correct, but I was not pleased. You are right, too, about wasted time. It took several calls, emails, and explanations because of shoddy work. It also made me wonder who else was getting my information ... ANY of my personal information. LOL, not to mention that when I was trying to pee in the cup, another lab client barged in on me because the drug screen toilet did not allow a lock and no one was minding the door for me. The whole thing was an invasion of privacy!
