CBD Administration in School? Policy?

Does anyone administer CBD at school? Do you have a policy? If so, what is it?

We have one student who takes CBD oil for seizures.. another one is on medical marijuana. Our policy prohibits the marijuana. No policy on CBD.

I do not and have never been approached about it. If I was approached I'd contact my Dept of Public Health.

This determination must be made by a school district. There are no provisions of state law that would either require a school district to treat CBD as equivalent to other non-prescription medications, nor prohibit a district from doing so. For CBD, which is not classified as “marijuana” in Oklahoma, this appears to be a local decision. School districts should be aware that cannabidiol has not yet been clearly excluded from the Controlled Substances Act at the federal level, although drug enforcement action involving CBD is unlikely, and clarification of its status is expected to occur in the coming years.

If a school district chooses to consider CBD a non-prescription medication parents/legal guardians may authorize a school to store and administer, the requirements of 70 O.S. § 1-116.2 would apply in addition to any specific policies adopted by the district. Because of the uncertain federal status of cannabidiol, a school district should not compel a school nurse to administer CBD if the school nurse is not comfortable administering it. In such a case, a district that chooses to consider cannabidiol a non-prescription medication should ensure that a parent/guardian’s written authorization for the school to administer CBD gives explicit permission to an administrator or a non-nurse school designee to administer the student’s CBD dosage. All directions for use must be included in the parent/guardian’s written authorization.

If a school district does not choose to consider CBD a non-prescription medication subject to 70 O.S. § 1-116.2 and associated policies, and does not adopt a specific policy addressing how students may access their CBD treatments, then students who are treated using cannabidiol should be permitted to access their CBD treatments in the same manner as the district provides for access to medical marijuana treatments for qualifying students.

This is what the state says. Basically, it's up to the district. Our superintendent is brand new. He will probably ask my opinion. I am unsure of what other schools do.

We're delaying a decision as long as possible, basically. We are telling parents they're free to give it at home, or come at lunch (or whenever) and give it, but unless they can jump through all these hoops we're not there yet. I'm sure an official policy will be coming, but I don't expect it to be soon.

Is there any evidenced based, peer reviewed research to back the use of CBD?

I would consider CBD 'alternative' medicine and would be very reluctant to use it without a clear rationale from the medical doctor.

Medical marijuana - is it in the form of a pill? Is it prescribed by an MD or OD and distributed by a legit pharmacy? Is yes, I would administer as prescribed.

If it is legal in your state, check with your state's board of education.

It was just made legal here and our state board of education put out a webinar about it laying out what we need to do.

Medical marijuana is a gummy. It is prescribed by an MD, however, state law states it is illegal to have on school grounds, even with an order.

The CBD oil is ordered by a neurologist. It is what the student takes when she has a seizures over 3 minutes.

And this is what is legal in several states. I haven't encountered any students prescribed/ordered it, but do know it is legal for parents to give it for students diagnosed with epilepsy in my state.

However, I know school staff giving it vs parents is very, very different. And right now, I think only Colorado allows school staff to give (and by school staff, I mean pubic school staff). Correct if I'm wrong, friend, though. This discussion intrigues me to no end. I'd be on phone with my department of health/school health department as well.

CBD is legal in my state too. We don't give ANY medication without a doctor's order and a pharmacy label, so unless Walgreen's or other licensed pharmacies are filling CBD prescriptions, it would be a no-go for my district. I think Marinol is the only legal cannabis in the state, and I've never seen it in the school setting.

There's only one FDA approved CBD product. My state does not allow school nurses to admin anything that is not FDA approved. Unless i got an order for that exact drug, then it's a hard pass. No way am i risking my license by giving a kid a gummy bear laced with CBD that was most likely bought at a gas station or head shop
