Are you paid when you clock out, or end of shift?

At the LTC where I work, we are docked pay for clocking in even 1 minute late, yet we are only paid until our shift ends, not at the time we clock out.

Most nurses are there at least 15-30 minutes past the end of their shifts and of course when there's an afternoon admission or it's a really busy day we're there much longer. I figure the owners are getting at very minimum 4000 "free" minutes of work out of me every year, and if you multiply that by every nurse in the facility, that's a nice little sum of money they are saving.

Their reasoning is that if they pay staff when they clock out, people will be dragging their feet to clock out. That may be true for a very few staff members, but I do not want to be there when my shift ends and if I am still there working after my shift ends, I want to be paid for it. The owners of my facility are quite affluent, and I think it's ridiculous that I am working for free every day to save them money. Is this illegal? How many of you are paid until you clock out as opposed to the end of your shifts?

Check your labor law, this is not legal in most states. I've seen companies have to pay a ton of backpay for such abuse.

To backdate your clock time to a preset time, no matter how long you work, is theft of service, just as surely as lying about clock time is theft of time.

Unless you are a salaried employee, the law mandates being paid by the hour, not the shift.

My place pays in 15-minute increments. Our shifts run 7-7. I can clock in anytime between 0653 and 0707, and out between 1823 and 1837 and be considered on time. Anything before or after those times we are docked or paid extra in 15-min increments.

I think it's illegal, someone may want to call the labor board.

Pretty much same system where I worked. Started getting repremanded for clocking out late. OK....so don't send me a new admit that's a train wreck at 6:55pm when I'm suppose to clock out at 7:15pm.LOL.

You can bet id be outta there exactly on time. To bad if something wasnt done, thats what the next shift is for. No way would they take advantage of me that way. No job is worth that, find someone who pays fairly and values the work you do or at least makes an attempt to appear to value it.

I believe that if you are paid hourly, that it is illegal to do what they are doing. Of course many places say that you have to get a supervisor's signature, if you are late. My suggestion to that would be if EVERY SINGLE nurse that stayed even one minute over, they call the supervisor to sign. After the supervisor gets tied up for several hours of each shift, signing cards, someone will get a clue.

Call them. What they are doing is illegal. They are tampering with time clock info. If you work it, they HAVE to pay you for it. I would love to be a mouse in the corner when the inspectors subpeona their timeclock info and the resultant fines they will pay. BTW they can also lose their 'license' to practice business in your state.

We're on the 7/8 split for time. If you work at least 8 minutes of a 15 minute time chunk, you get paid for the whole 15. So ifyou clock out at 1908, you get paid til 1915. But, if you clock out at 1907, you get paid up til 1900 only.

yup, labor board....usually there is that 7/8 split thing going on....though i have seen recently places that dock for the minute.....ordinarily the person who is chronically "a little late" would be addressed in their yearly eval....and might be the first to go in a lay off......good luck, and stop giving away your time...!

Hmmm, I KNOW we need time clocks at our facility. We just might be the last place on earth who doesn't have them and I know it would solve many of our problems. Too many problems with people leaving early and still getting paid, people coming in late and not getting docked...it's cRaZy and so ridiculously unfair.
