Can anyone tell me when to expect to get EAD once you file AOS. I already have visascreen.

If the dependents are not in the US at the time of the filing of the petition, they are not included as they cannot get an Adjustment of Status if they are not here on a valid visa. That is only available to thise those that are in the US.

They will have to wait the two years, that is why AOS is never recommended if the family is not with you. The wait will be longer to add them then if you go consular processing.

I got the receipt for finger-print on NOV-17, once I have done with it, how long it takes to get EAD?, and what would be the status on I-485 which I have submited on OCT-30-2006?

Sorry, it is one or the other. You take yourself out of the running if you go for the lottery. ......and take a close look at when you would be able to get a visa via the lottery, it is in very small letters, it is definitely not immediate.

I would be glad if you could clarify why you cant apply for GC lottery if

AOS is held up in retrogression. I note on the dv lottery site on FAQs they note that you can apply for lottery even if you are in USA on another visa.

Is waiting for AOS another visa?

On another visa, means that you are in the US, perhaps on a student visa, or tourist visa. If someone is under AOS right now, then they have a petition pending and you cannot have two pending for permanent status at the same time.

The other thing to pay attention to is that with the green card lottery, it is not a green card that starts immeditately, usually not for another year or two after the winners are selected.

It is in violation of US immigration law to have two permanent petitions pending. You will be getting a green card much faster if you just do it the normal way, especially if you are an RN. Even with the retrogression going on at present. It will be faster.

And if you are in the US waiting for the retrogression to be lifted, not a smart move. It definitely will not be over before the visa expires, and the green card lottery, if you were selected, does not start right away, so you would be here illegally and then would not be able to get the green card.

i agree with you concerning green card lottery and pending AOS.

If your AOS is already filed, that means you are an adjustee. (which means you are not on any kind of visa). For example, I was on student visa but as soon as my AOS was filed , I am not on student visa anymore. II dont have to take classes (but i can if i want to), Submitting GC lottery means that you are trying to get GC by another way at the same time, which is unacceptable. You might get denied both. So I would not play that game, even tough it was my question, I think that would be the bad idea.

The package was sent on 10/20/06. The received date is October 23rd, 2006 and the notice date is October 31, 2006. The processing center is Texas service center. I am just waiting for the finger print and EAD card now. Hopefully, I will be able to start working Feb. next year.

hello, the finger printing has nothing to do with your EAD. THe finger printing is for your adjustment of status and green card application... you must be receiving your EAD anytime soon...

Yes, they were sent to my lawyer and I just got them today.

The package was sent on 10/20/06. The received date is October 23rd, 2006 and the notice date is October 31, 2006. The processing center is Texas service center. I am just waiting for the finger print and EAD card now. Hopefully, I will be able to start working Feb. next year.

I did not bother to bring the rest of my family here because of the reason that I don't know yet what will happen next... I don't want to take the risk of losing lots of money if we all went here at the same time... I know that they're not included in my petition for AOS simply because they're not here with me in USA. But my lawyer applied for them with I824 case type and I paid $200 for them through money order payable to USCIS... I just hope that in near future we'll all be here and be together again...

what is your service center? if it's texas then you'll just have to wait for about 2 weeks for your EAD... in my case, i did my fingerprinting last nov 9, 2006 and just today, nov 20, 2006, i received my EAD already... so it only took 1 week, FYI, my service center is texas... I went to SSA to apply for my SSN so i'll be waiting for 10-14 working days to receive it...

I just arrived here via tourist visa last june 20, 2006 and my case was filed last october 23, 2006. Received my NOR last october 30, 2006 and my appointment notice last n0vember 2, 2006. Did my biometrics and fingerprinting last nov. 9, 2006. Received my EAD today, nov 20, 2006... my service center is texas...

my question is that i got a letter from USCIS today stating that my I140 petition have been approved, and also a letter regarding my I485 application requesting for evidences like VSC from cgfns, a copy of my current state license... they're giving me 12 weeks to submit these RFE... if i happen to submit all these RFE, what will happen next?
