Wow, the tide has really turned here, imo. I read this article and then went down to read some of the comments. I expected to see a mix of supporters and those who are not impressed with the McMaths. I quit reading after about 5 minutes. Not one comment was written in support of the McMaths in their lawsuit. Not a single one.

The timeline of events is waaaay different then the story that was first being told... If I remember correctly I recall Grandma stating she was waiting with Momma Nails when Jahi was transferred to the PICU and that they were told to wait before being allowed in the room and after over 45 minutes it was Grandma who instructed Momma to barge in and demand to know what the hold up was. But now in these new court records it says Grandma didn't show up to the hospital until after 10pm.

One thing I find telling is that the hospital was investigated by state and was found to have followed proper protocol. I don't believe they received any cites by the state surveyors.

Not only that but the family continues to refuse to allow the hospital to release any info. I have no doubt that the family will try to have these court records sealed just as they did over a year ago.

I don't think I've heard ANYTHING from Jahi's real dad or that side of her family. They have remained silent through this entire ordeal.

There was a minor citation regarding a preop checklist and nursing documentation but nothing to do with Jahi . The initial stories have changed significantly over the past 15 months even vs the details submitted with the initial court filings. Im guessing the court wont overlook the discrepancies.

If there was ever a malpractice case that hinged on the content of the nursing documentation, this is it. I really want to know if her throat and neck were visibly swollen before they attempted intubation.

I have taken care of a few overweight adolescents with sleep apnea and the same surgeries in an adult ICU and they had minimal to no post op bloody sputum. If this patient had a carotid hemorrhage due to an anatomical anomaly, her neck would have swollen and occluded her airway. This family might actually have a case if this was a botched surgery. Neosynephrine spray is not a treatment for that.The only way to fix that is to take the pt back to the OR.

The nursing documentation is the key in knowing what really happened.

At times, not always, but at times, in certain parts of the country, I have seen a double standard in the delivery of healthcare in different facilities.

If the patient is poor, black, hispanic, uninsured or on medicaid, some of the medical staff are unwilling to put in much time or effort. It is very possible that the ICU nurse notified the surgeon repeatedly and to no avail.

This very tragic case hinges on the nursing documentation.

If grandma did give Jahi a hamburger,and she suctioned her too,can Nahlia go after her Mom's own and sue her?

Likely because he doesn't agree with mom's tactics and has yet to give up parental rights. Step dad cannot claim damages for a child not legally his if you notice pain & suffering is mom & grandma not step dad. Surprise she didn't add the siblings and nephew.
