The larger of the two documents has me absolutely fascinated by the ethics of this case. Forgetting Mama Nails and Not-A-Nurse, and all feelings associated with the medical ethics, the LEGAL ethics are sucking me right back into this mess.

So, the court refuses to step in with medical opinion regarding the determination of death, which makes sense. But they recognize the people do have the right to religious determination as well. After all, murder (if religion views ending ventilation as such) is a giant no-no. (There is obviously a giant space between the medical knowledge vs. spiritual belief there.) The court also admits that resources are of consideration - removing an ICU bed and ventilator from another fully living person to ventilate a dead person would not be ethical either.

I tell you this much - I'm glad I'm not the judge on that bench. Even though I'm an atheist, I have such HUGE respect for personal belief systems and couldn't imagine feeling completely right with ending ventilation of Jahi knowing what that means religiously for someone who might view that as murder.

That said, my personal belief is dead is dead. As devastated as I would be losing my child, I couldn't leave his or her body suspended like that. To have his sister or her brother watch for years, believing it's just a coma.... :( Nope, I'd need closure. I couldn't drag that out.

Good for the hospital recognizing the contradiction between saying she is and is not living. And good for their insistence that the matter of whether she is living or not has been legally determined. Someone said ages ago that this case won't set precedence. I don't know enough to say anything one way or the other accurately, but surely it could???

The hospital & Dr. Rosen posted rebuttals to the Winkfield family's reliance on a letter of potential eligibility as proof of life. The first page alone is interesting.

They go to court tomorrow! The judge made a statement that looks like CHO and Dr. Rosen will prevail and unless there is compelling evidence, he isn't going to consider overriding the death certificate.

I'm hoping if the malpractice suit doesn't get thrown out, the judge will force the scamily to release the hospital and Drs from HIPAA so that they can finally tellus really happened!

She was given initial eligibility pending clinical review. The parents are conspicuously quiet. NJ Medicaid is not easy to get. The letters only state pre-auth note no dates are this year. I've read more than one nurse has left the case because of work conditions.

A oxygen concentrator, back up vent, marine battery, primary vent, suction, back up suction, feeding pump, percussion vest, cough assist machine all use electricity and create heat that even the best AC can't fully remove. Combine that with a two bedroom apartment with at least mom & stepdad plus younger sibling. The article posted this morning says she has an iPod running at all times plus tv on constantly both generating additional heat. Heated humidifier for the vent often running at 37C. I'm sure the temperature is less than ambient in the room. Probably relegated to the one bedroom. Pediatric home are is tough enough add in all the family drama plus the fact that you are attempting to stall natural decomposition on a child already declared dead.
