Does a case still left with i140 approval has some hope to gain visa by sept or oct

A case whose I-140 petition isn't approved yet is technically still not part of retrogression. Remember, I-140 processing really has nothing to do w/ retrogression. It gets processed whether or not there is retrogression or none.

An applicant going the consular processing route is only under the influence of retrogression if the file has already reached the National Visa Center (NVC) for the Visa Fee bill and DS-230 forms (packet 3) and or in packet 4 already and the file only reaches that stage if USCIS has approved the I-140 petition. The USCIS sends your case to NVC for further processing (packet 3) once they have approved it already and NVC will only actually process your file if you have paid the Visa fee bill and has sent the DS-230 forms back to them.

If your I-140 petition will not be approved anytime very soon or it gets approved very close to Oct and there would be another retrogression by Oct. then there is really a very slim chance. It depends on the timing but the way it is now (still I-140 petition pending) there is a strong chance that by the time your I-140 gets approved, retrogression would have commenced again by Oct. or maybe even sooner for some countries (as roughly predicted by some law groups/firms). It's like going out of the pan and getting into the fire. And there would always be that chance that your I-140 would not even be approved by Oct. if your I-140 is being handled by Nebraska Service Center as this center usually takes 6-10 mos. or so for I-140 processing.

*Note: USCIS or the Dept. of State did not mention any dates on how long things will stay current. It will be determined as processing goes by. It may only stay current for the month of July (esp. for some countries), maybe another month or so but nobody knows.

This is just a temporary break in the clouds. Retrogression will be back very quickly.

Retrogression has not been announced by the US government as being over. This is just an open window to clear up those that have had pending visas for sometime. The visa number is not unlimited, and there is no Scehdule A, so nurses are still in with all others that have pending petitions.

Please do not make final plans to sell your house, etc., until you get word from the US Embassy that you have an appt scheduled, that means that you have a visa available.

But remember that this also opened up the PD dates for all others that have been waiting. And 150,000 petitions were submitted the day that they were accepting petitions for the H1-B visa, and they were gone in one day.

We have seen so many things happen here in the past, that unless someone already has approval of the I-140 in hand, there will not even be a glimmer of a chance at this time. And much then depends on how quickly that the agency and attorney does things, and many move very slowly, and I mean slow.

Sorry, but the retrogression is not over. There is no Schedule A for nurses, or other fast-tracking of nurses. The US government has not come out with anything that the retrogression is over.

Consider this a lucky open window for those at the end of the processing, and have been waiting just for an interview date, or those that already have approval of their DS-230 and have been waiting for the final instructions.

There are hundreds of thousands that have been in-line for a green card, and these are not even nurses, but they are also under the EB-3 classification. There are only going to be a small number that will actually go to nurses if you take into account all that are waiting.

Imigration fees are going up an average of 80% the end of July, do not expect to see agencies running out to get things paid now in most cases. Unfortunately, not the majority of them will be willing to do things at this time.

If you are currently in the US and working on the TN and apply July 1 for I140/1485 is there a chance that this will allow enough time?

but the current visa is not current, It does not start until july 1st. What is the use of everyone getting their hopes up when the catagory covers everyone and no guarantee that we are going to get visas. Yes it is nice thinking that but really we only have a shot

i have my I140 approved, and is on AOS, n my PD is oct 13th '06 ,.. so wat are my chances..input wud be much appriciated.

yes!!!! all of the retrogression dates are now current. this is fantastic news.

the main question that our clients have been asking us is: why did this happen? here is why: the uscis is authorized by congress to approve 140,000 employment based immigrant visas per year (including dependents). this year the cis (and dos) are falling far short of those numbers; thus they are aggressively moving those dates. hlg expects that the dates will stay current until the october bulletin. until then we should see many needed workers enter the us. this is fantastic news!!

in october the numbers will likely retrogress again; but for a few months - paradise. (fyi_ the us fiscal year runs from october 1 - september 30).

as suzanne4 has posted, the retrogression is not over. this is just to accept pending applications. there is no reason to celebrate. thousands of applications are going to clog up the pinhole sized eb3 immigration pipeline and i'll bet that retrogression will be back as early as august 2007. just look at the h1b category, 150,000 slots vanish in one day. there are simply too many nurses and the usa will not accept all of them.
