PD is date of your I140 filed and approved. Depending on which service centre your file is at depends on how long but you are looking roughly between 6-9 months approx as long as your file is ok and nothing extra is requested
Thank you very much for the quick reply Silverdragon! Therefore I will be looking forward for my approval on July 17 for it would be 9 months from the date it was received by Nebraska processing center.:nuke:
that is a rough estimate but nothing is written in stone but check out the Nebraska centre thread that should give you some rough ideas
July 1 is a weekend day, so they will not be accepting petitions to the 3ed of the month. If your attorney has not already started the process it is going to be very hard to get things done by then. Most importantly, they are going to need to include a Labor Certificate for the job with the I-140 petition, this usually is what holds up things and if a union hospital it needs to come from the union. And many times the job has not been posted to meet the requirements of USCIS and this needs to be done.Very few of the visas that will be coming out will go to nurses, most are going to go to technical people that have already been in the US for several years and have just been waiting for their PD to be current. Expect visas to be gone very quickly since most that are waiting for the green card have been in the US for several years with the H1-B visa.
I do not work in a union hospital as I am in Arizona. Don't think there are many union hospitals here like there are in California. My attorney was completing the requirement of documents all along during retrogression as they wanted to be ready when there would be a chance to file. You are right this is NOT an overnight task. It has taken me many weeks to provide all the required materials.
Unfortunately, I literally started a new job one day before retrogression started but was on OPT and have since received a TN and was lucky enough to continue working.
The only thing that was not completed for filing was photos and medical exams which we will complete next week. I realize there is not enough time to actually get the green card just wondering if there would be enough time to at least get the EAD processed during this window of opportunity.
My attorney states that they do not have to file anything with the DOL but they do have to have a job posted within the hospital for the required time. That is not a problem in the hospital where I work. It does not have to be on my unit although that would not be a problem either as there have been openings on my unit for the entire 8 months that I have been working there. It is a great unit and I love it there.
My attorney feels that the critical point is filing even if it means that the green card application may take years if nothing is changed. I understand the EAD can be renewed yearly during the pending process. Being in the US already seems to put us at a slight advantage. I feel very fortunate to be able to continue working through this process.
Are they not accepting applications on July 2? You mentioned the 3rd.

Yes, they are accepting on the second. Looked at an old calender when posted that, knew that the first was on a weekend. You are better shape than most, as the I-140 is complete and ready to be submitted, but for those that are just starting over the past two weeks to get that done, they will not be so lucky. Looks like you have an attorney that is on top of things, and I can not say that for all. Your attorney is 100% correct.
