I am starting a new thread to track cases from NVC - embassy to GC.

The best news for RN in China, Phillippines and India has been great and informative thread, but I think it is more appropriate and convenient if we start a new thread.

Also with the rapid scheduling of interviews for most of us, I am looking beyond the CP and anticipating the GC!

The August interview schedules are out already in India, and recently in the Philippines and hopefully in China.

Here is my case details

NVC forwarded packet 3 : April 5, 2005

Packet 3 sent back to NVC : May 3, 2005

NVC case completed : May 16, 2005

Consular Interview : August 29, 2005

Visa received : ???

hi guys!

i received the instructional packet to my lawyer from nvc. as promised here are the information stated there:

dear sir/madam:

this letter contains information for processing the immigrant visa case of my-name. our files show that you are the applicant's attorney of record. we have received all necessary immigrant visa and applicable affidavit of support fees for this case.

each traveling visa applicant must now complete applicant document processing. please go to the department of state website at the following address: http://travel.state.gov/visa/immigrants/info/info_1335.html. click on the applicant document processing link and follor the instructions.

as part of the applicant document process, each traveling applicant will be required to return a ds-230, application for immigrant visa, to the national visa center at the following address:

you must return this page along with requested documents to:

national visa center

attn: cmr

32 rochester avenue

portsmouth, nh 03801-2909

when returning documents to the national visa center, failure to adhere to the following guidelines will result in a delay in processing:

- failure to return this page

- failure to write the applicant's name in the upper right-hand corner of all documents

- attaching documents for other cases to this page

- sending information for other cases in the same envelope without attaching the nvc's letter to the front of each case's documents

(and so forth... there is a bar code with my case number below the page).

then nvc sent this attention page:

attention:

the cut-off dates in most employment-based preferrence categories are expected to advance rapidly during the coming months. these movements are intended to increase demand so that all numbers within the fy-2007 annual numerical limit can be made available. after such rapid advance of cut-off dates applicant demand, primarily for adjustment of status cases at uscis offices, will increase dramatically. therefore, the prospect of cut-off date retrogressions in certain categories will also increase in late summer or early fall. interested parties should remain alert to this possibility in the coming months.

i don't think there is a visa allocated for me..esp for those on consular processing. they usually allocate visa to adjustment of status applications first. so, this means i'd have to wait for october again. but i will still mail my ds-230 tom again. hope they won't ask me to do it all over again when visa becomes available. my original documents are with them and I have to send them again!!!

They do not allocate to those going thru AOS first, the issue is that most of those have much earlier PD dates if they were in the US on the H1-B visa. Many have been waiting three years or more.

If you already had approval of everything before the retrogression last year, make sure that they get in what they are asking immediately. You do not know for sure but they may have a visa number for you. No idea if they are doing this or not, but we know that they have used 60,000 visas from the 140,000; so more could be on hold. If they do not receive the documents that they requested in a timely fashion, then there will be no visa at least until October at the earliest.

And again, for those that have interviews scheduled, do not consider changing the date of your interview; or you may find that the visa number is no longer there. They are trying to get these numbers used before the end of the fiscal year.

I m very confused. wat happens now, wud my file still go to NVC in all this sequnce of events.. or wud i be still on wait under EB3, for my PD, and wat is the significance on processin times for respcetive centers like texas, nebraska etc. cuz i m not sure wat does the time on those reflect. do is still follow that processin time,even if my i140 is approved, shall i be keepin eye on proceesin time for i485. pls.. give me some details.. wud be much appriciated..

If you are going through the AOS route, your file do not get transfered to the NVC. This is only for those going through the CP route. Both your I-140 and I-485 are handled by the USCIS and you can see your status from their website.
