I am starting a new thread to track cases from NVC - embassy to GC.

The best news for RN in China, Phillippines and India has been great and informative thread, but I think it is more appropriate and convenient if we start a new thread.

Also with the rapid scheduling of interviews for most of us, I am looking beyond the CP and anticipating the GC!

The August interview schedules are out already in India, and recently in the Philippines and hopefully in China.

Here is my case details

NVC forwarded packet 3 : April 5, 2005

Packet 3 sent back to NVC : May 3, 2005

NVC case completed : May 16, 2005

July Visa Bulletin to be revised?

Please be advised that AILA, the American Immigration Lawyers Association, has just released the following announcement.

"We are hearing from multiple sources that, on Monday or Tuesday of next week, State Department plans to issue a revised Visa Bulletin for July 2007. This revised Bulletin would retrogress some or all of the employment-based categories, very likely to the point of unavailable. Reports from AILA members about unusual levels and types of activities by USCIS indicate a particular push to adjudicate employment-based adjustments currently in the pipeline so as to exhaust visa numbers for fiscal year 2007.

This follows the actions of USCIS in June, when it began rejecting EB-3 "Other Worker" adjustment applications even though the Visa Bulletin showed an October 2001 cut-off date, on the basis that the "Other Worker" numbers for the year had been exhausted."

If this is accurate, Adjustment of Status cases (I-485 cases) filed in July will all be rejected and returned to us and no AOS (I-485 cases) could be filed in July. It would also effectively cancel all Immigrant Visa appointments at US Consulates. We will provide further updates as they become available.

this has already been quoted in another thread. Not surprised really considering demand, nothing we can do but wait and see

If a DS-230 has not already been submitted and approved, there is not a chance of having an interview shortly. Until the DS-230 is accepted, the file is not complete. It can be months to get approval on that.

But the bigger question for you is why you have a PD date from so long ago and are not already in the US. Is it because you were working some place else? Or is it because there were issues with your file? How long did it take to get approval on the I-140 that you had submitted?

I attended an interview on 2001 and signed some papers offerd by agent.I prepared for the exams I got CGFNS and could not clear IELTS . In 2005 I moved to UK. There was a job crisis here in 2006 and I Took Ielts and emailed old Agent. She replied like'we will think about you when u clear NCLEX. I cleared Nclex in november and they said they are moving the papers and hospital is still intrested in sponsoring me and thats the full story. So thanks for the reply ..anyway Its long waiting again

this is absolutely correct and very useful information for those still wanting to join the incredibly long line for the coveted greencard as nurses. this statement should be the number one rule in nursing retrogression 101 to avoid frustration. thank you very much suzanne4!! :nono:

oh well..nothing that we can do really. just hate it that my packet 3 in in the mail again..and i don't know what to do. they asked me to re-submit my ds-230 and my agent sent me the files again. if the visa is unavailable this coming week, should i send the packet 3 all over again?

If NVC asked for a file to be updated, then supply them with the information that they are requesting. Do not delay doing that. If you already had a DS-230 that was accepted last year, and then they have sent this, there is a good chance that they may have assigned a visa number for you, but cannot move forward until they have updated information on you. Not something to take lightly, or if they do have a number assigned for you, it will be recapped and moved on down the line.

That visas will not be available again, does not mean that you have not been assigned one if you had a completed file. If you want my opinion? Get it done as soon as possible.

Until NVC asks for something to be resubmitted, you do not send them anything. They will contact your attorney when and if they need something updated.

There is no reason to phone them at this point in time. You need to have approval on the DS-230 first, before anything else.

you are right fruity. get it done. send all those documents that nvc requested you to send. my lawyer eventhough he haven't receive the request is already asking me to prepare all my documents and send it to him as soon as i have them. it is better to comply and wait rather than not complying at all.don't be broken hearted, cheers!!!!go on with your life.

don't depend your life in going to us, if it comes - it will come, we just have to wait.

i received the instructional packet to my lawyer from nvc. as promised here are the information stated there:

this letter contains information for processing the immigrant visa case of my-name. our files show that you are the applicant's attorney of record. we have received all necessary immigrant visa and applicable affidavit of support fees for this case.

each traveling visa applicant must now complete applicant document processing. please go to the department of state website at the following address: http://travel.state.gov/visa/immigrants/info/info_1335.html. click on the applicant document processing link and follor the instructions.

as part of the applicant document process, each traveling applicant will be required to return a ds-230, application for immigrant visa, to the national visa center at the following address:

you must return this page along with requested documents to:

when returning documents to the national visa center, failure to adhere to the following guidelines will result in a delay in processing:

- failure to return this page

- failure to write the applicant's name in the upper right-hand corner of all documents

- attaching documents for other cases to this page

- sending information for other cases in the same envelope without attaching the nvc's letter to the front of each case's documents

(and so forth... there is a bar code with my case number below the page).

then nvc sent this attention page:

the cut-off dates in most employment-based preferrence categories are expected to advance rapidly during the coming months. these movements are intended to increase demand so that all numbers within the fy-2007 annual numerical limit can be made available. after such rapid advance of cut-off dates applicant demand, primarily for adjustment of status cases at uscis offices, will increase dramatically. therefore, the prospect of cut-off date retrogressions in certain categories will also increase in late summer or early fall. interested parties should remain alert to this possibility in the coming months.
