I am starting a new thread to track cases from NVC - embassy to GC.

The best news for RN in China, Phillippines and India has been great and informative thread, but I think it is more appropriate and convenient if we start a new thread.

Also with the rapid scheduling of interviews for most of us, I am looking beyond the CP and anticipating the GC!

The August interview schedules are out already in India, and recently in the Philippines and hopefully in China.

Here is my case details

hello, i'm new here but i've been following this thread for a long time now. like most of you guys, my case was completed sept 2006, and again like most of you, NVC is requesting an updated DS-230. This request, I think is the same for everyone who had their case completed, but were caught up by the retro. It's the ist time that NVC did this, for some reason. I don't believe that if your case is still in the NVC and not in the consulate right now that you won't get your visa this year. I believe there are a lot of visas for the Philippines as shown in the june VB, we were the only country that jumped to 2005 mainly because a lot of nurses have already left the country because they benefited from the recaptured visas.Majority of immigrants who consume EB3s in the Phils are nurses. As a result, the line got shorter so more visas will be available, maybe beyond october and upto december 2007. If your fee bill was already paid last year before the retro, I think there will ba a visa for you this year. I hope i'm right

I understand how you feel, though I am not shutting my eyes to reality that retro is still here and that there is a very slim chance, but of course, I would want to think positively that negatively to keep me moving on... Just a thought though: Most of us who are stuck in packet 3 are being asked to submit another ds230, either that case was completed or not... I was just wondering why would they ask to update our ds230 if there is no chance at all that we'll be able to get an interview.... they should just request for it when a visa number is available for you. Why? because what if we didn't get an interview, and it lasted another year or so, does it mean that if the VB gets current with our PD's they'd request another set of NBI, ds230. etc... Again, this is just a thought that makes me think positive, and if it comes, it comes!

The DS 230 that they are asking us to re-send is the same one before (with July 31, 2007 expiry), they do not have a new form yet (even for download in the state.gov website) so I don't think they are making us re-send because of the expiration date of the form but maybe so that they will know if there are additional dependents like if someone gave birth during the retrogression.

This is what I think unless someone here actually have a DS 230 that will expire beyond July 31, 2007? my lawyer emailed me the same form as last year.

But the forms being downloaded mow are the same forms as the last time.... it will also expire on July 31....

you are just downloading the forms? you are not waiting for the ones from your lawyer? those with the bar code? My lawyer usually send them by mail and I'm the one who mails it to NVC.

Hi Leis23, my lawyer emailed me the forms just like ladt year. It does not have a barcode in it. This is how we did it last year. I just download the filled-up forms that they attach in their email then I sign it and send the form together with the clearances to my lawyer.

okay. my lawyer sent me the entire packet 3 so i could mail it myself last time. i figure he will send it to me again. at least i know i sent my documents myself. i usually use fedex.

He everyone, we constantly monitoring NVC thru phone and for this week alone, we made a call almost everyday and we received 2 different responses. The first one was "The lawyer will be contacted in 60-90 days. If you change your address......" and hen after two days, "The Visa Fee bill was sent to your lawyer on Sept 2006. Wait for 2-4 weeks to process....."

Both (twins) have the same message. I already advised them to email their agency and re submit the DS230 questionaire the've given to them before. Tihs is to anticipate the possible request for it.

My only concern is, when the same documents were requested/processed last year (as i recall because I am with them completing it), it was one month close to rerogression. Well, If we will calculate the time they spend before the completion of documents to submission to local consulate, it will take them another 2-3 months in which the next predicted retrogression will takes place. I hope it is not.......

the thing is retrogression hasn't finished, all that has happened is a number of visas have been released extra and will go to everyone waiting not just nurses

THE PERSON WHOM I SPOKE WITH SAID DS230 RECEIVED AND COMPLETED SEPT 7,2006.MY FAMILY PRIORITY DATE IS SAME AS MINE MAY 6 2006. Hi!

This is one of the reasons why we don’t advice AOS to those who have family members left behind in their home countries in the light of ever present risk of being caught by retrogression. In your case, that’s under the bridge now.

First off, the embassy person whom you talked with last year was telling the truth; she did not lie. Your family member were not allotted the visa’s (and retrogression caught on with them) last year since you went through AOS. If you were just processed via CP, then it’s a different story. So is the person whom you talked with just recently. There is SOME chance that your family will get their visas this time as you are well ahead of the processing. But, remember there is also the PD and per country limitations. Putting together all these and other factors, nobody -even the consul himself- will be able to guarantee you anything. This is the risk you chose when you went through AOS. Play your cards properly this time. Prepare all documents ahead of time and pay all fees on time and you’ll be fine. Then again, no guarantees.

Kind reminders: please don’t type in capital since we see this as shouting. You can type in regular manner; besides, it’s easier for the eyes.
