NO VISA for LVNs!!!

Hi I am makisig I just recently passed my LVN exams last March2007. I would like to know my case especially those who have the same case like mine.I am currently here in California.I had my consultation with 2 immigration lawyers...both of them told me I cant fixed my papers to change for immigrant status or even work permit ( even it is available this time ) because I am holding a vocational licensed.Even of some of facilities that I applied told me...there is no chance to fix it.I was wondering how those LVNs whom I know they dont originally lived here and came here in visitor visa without any authorization papers to work....I am just holding a visitor visa and can stay until sept 2007 and I am afraid to work because of immigration law.Even I want to fix my papers there is no way to do it..I am totally upset and depressed after all the hard works and effort...just like what my 2 lawyers told me it will be hard the less chances...Does anyone who have the same cases with me and was able to fix there papers even for work permit ...Pls respond...There is a a small facility would like to help me but I am doubt that they can help because of those information that I heard from the 2 lawyers...PLs advice me ...Thanks Honest comment only OK!!!

your lawyers are correct in that us immigration regulations require one to be licensed at educational standard as professional nurse in country of origin. since phillipines professional nurse standard is bsn rn, you need to hold that credential. this is why lawrence and suzanne discourage those from entering lpn education programs there. visitor visa does not permit working in us.

2 diff. immigration lawyers saying the same thing and as well as the facility saying that they can't hire a foreign grad. with just the lvn pretty much closes it as far as working legally is concern. likewise, an adn earned outside the us is not qualified for petitioning as well. a minimum rn-bsn is needed to be qualified for petitioning for a green card.

if you do not know any people personally that are said to be working as an lpn in the us who graduated outside the us and you only heard it from someone else means it does not exist and if there is actually one you know personally then it could only mean they are working illegally.

I don't know any of the details here, but one question you could possibly ask one of the immigration attorneys is if it is possible for you to be sponsored, assuming you could find a facility that would do it. Where I work, we have a woman who crossed over illegally from Mexico- didn't even have the visitor's visa. She has the equivalent of a master's degree in nutrition and we are able to sponsor her based on the argument that she possesses skills we couldn't find from an American or legal immigrant. Perhaps if you went to a facility that serves primarily Filipinos or something, you could make a similar case.

I didn't know. I don't understand why, if the US has ADNs. I can understand needing to get what the country of origin requires, but if the country of origin has ADNs, why can't an ADN come here on a work visa?

Or is the US the only country that has ADNs?

The LVN license from the Philippines does not permit anyone to work in the US. It is not accepted for immigration purposes.

Master's prepared in nutrition is an entire different thing.

US government requires that the nurse be a first level general nurse in their country. And there are not any countries that have that with the ADN. Most actually do not even have that designation.

If that were the only degree in that country, then it would be accepted, but if there is a BSN, then that is required.

And if the nurse with the two year degree from the US wishes to work out of the US, then they need to meet the educational requirements for that country, and most require them to have the BSN or at least the same amount of education that their nurses have. Example, UK has three year programs, so the nurse needs at least a three year degree for there.

If you get ADN from a usa school, an employer can petition for you too. BSN and Msn is only if you were educated outside of the usa.

There is not one facility in the entire US that can legally petition you or even get you any type of visa. The certification that you have is not accepted in the US for immigration purposes. And this a very well known fact.

The only problem is that the schools in PI do not tell you this. You need to have a little chat with your school when you return home.

The only foreign trained LPNs or LVNs that you see had a green card or US citizenship before they even attended school there, or they are married to an American. And to get married just to be able to remain in the US is considered immigration fraud.

And if you check out the Filipino Forum here, you will see a large number of threads on this very topic. Sorry you had to find out once you came over. But please do not try to do anything illegally. There are no legal options for you, the immigration attorneys that you spoke with are 100% correct.

Just remembered something. You graduated from a BSN program in your country, and came to the US on a tourist visa to sit for the exams. You sat for both, per your other posting.

There are no visas available, and even if you had passed the RN exam, there is still not one thing that anyone can do for you. There is a retrogression in place, and there are currently no visas available for any nurse to work in the US. And there will not be before your visa is up. You also need to be in the US for about five months and without any work in normal times before you can get the documents that will permit you to work. Most are unable to last five months and resort to working illegally. And they are being picked up and deported. Attornies are not even filing the paperwork until the person has been in the US for at least three months, but again, there are no visas that are currently available for anyone.

And by you staying or wishing to stay, you just have made it harder on the next person that wishes to get a tourist visa from your country. It is actaully in violation of US immigration law to come to the US for the sole purpose of staying and finding work and not returning home.

Sorry, but in CA for five months with no income coming in? Just is not going to happen and you will be trying something illegal like the others and will be deported. And then not permitted back to the US for ten years.

Sorry, but you have known what you were planning to do before you came over, no sympathy from me.

YOU can't be petitioned if your not an RN.... there are no visas for LVN's

Go to the international forum and read what happens to people caught working here without permission. You are the same as everyone else that is illegal... they don't care if your a doctor.. you need to be petitoned

It is like sneaking into your neighbor's home.....

Think about it.... you try an open window, or make a bigger hole in a screen, check the back door to see if it is open... and sneak in...

WHY not use the front door the way it was meant to be used... walk up the sidewalk and knock, present yourself and be invited in....

Anything less is considered breaking and entering. Follow the rules and be invited in, anything less is a crime

Take a look at where they will keep you... yes a federal prison, you will wear prison jumpsuits...and be treated like a criminal. Why because you could not wait and do it the right way. You need to return home and get an RN license. Do it the right way... you already did not tell the truth when you came for a visit and then tried to get a job...

Sorry, but you need to return home and do the right research and get an RN degree and then follow the rules, like all of the other RN's here. There is no easy way, just hard work and planning will get you to your goal..

You need to listen to the advice being given to you here...if you don't and try to take a short cut you will end up in prison
