The US Consulate in Mumbai published partial data on their advance copy of the May VB.

The Dept. of State will publish the whole thing on their website later on or tomorrow.

EB3 most other countries is March, 2006. EB3 India is Nov. 2001.

Thank you Lawrence, you explained this very well. It's about time those going thru CP have their day. I have always thought it unfair that there are people who can cut in line and take shortcuts. Never should have been allowed in the first place IMO.

At least AOS applicants are already here in the US. Those going the CP route are waiting patiently in their own countries for years.

Remember...you are talking about those cutting in line but there are many of us who DO NOT cut in line and are waiting a lot longer than those in CP Processing so just remember that as well.

But the point I was making is, those doing AOS are in the US already, so you have that advantage over the CP applicants.

That is true, but with limitations until the green card is processed . I am thankful for that, don't get me wrong, but certainly the process is a long one in AOS and many of us have been patient for multiple years. We could be on a temporary visa anyway but desire to have a permanent status esp for our children who wouldn't even be able to get part time jobs as teenagers without it, and have to leave when they are 21. We have been in the US since 2000 and been paying taxes all along and not cutting ahead of those who have been waiting longer. And it is difficult not to make a comment when accusations are unfairly being placed.

If consular processing, there's a chance they will touch those with early 2007 PDs.

Just this month, they already started processing up to the Nov. 2006 PD and would not be surprised if they will be able to go upto the Dec. 2006 PD within the next few days.

Also, just clarifying that technically, adjusting from tourist visa is not "illegal" per se, otherwise it would not be allowed to be filed from the start.

It's just that USCIS recognizes that some who are in the US in a tourist/visitor's visa may really not have a dual-intent from the start and some may do. By allowing them to file AOS, is like giving everyone adjusting from tourist visa to GC a benefit of a doubt until their case has been reviewed thoroughly by a USCIS adjudicator and a final decision is made to whether label it as having dual-intent or not. Since this is greatly subjective, some who really have dual-intent may be able to go through (as what usually happens) while others may not be so lucky.

However, many also argue that almost all coming from tourist then adjusting afterwards really do have dual-intent from the start if you really think about it.

It's a loophole that some are taking advantage of and even bragging out in public.

Lawrence, this is very encouraging news. Could you please let us know where we can find this info? I thought the latest bulletin was saying they are processing only up to March 1st 2006?
