The US Consulate in Mumbai published partial data on their advance copy of the May VB.

The Dept. of State will publish the whole thing on their website later on or tomorrow.

EB3 most other countries is March, 2006. EB3 India is Nov. 2001.

Is it possible? Yes. Will it benefit everyone, no. Not because someone's PD becomes current means they will be getting a GC with 100% guarantee.

If someone's case is incomplete or either USCIS or NVC/consulate abroad cannot close out someone's case because it is lacking something then there is no way that that person will get a GC.

The very reason the dates are moving at all is because USCIS cannot adjudicate their cases enough to use up the visa quota. By moving the dates forward, it is giving applicants who went through CP an opportunity for their cases to close out. And not all going through CP can have their cases move forward as well. You will always read or see posts about people whose cases are still in NVC. Whatever the reason is, it is stuck there and people with a much later PD under CP can pick up the slack as well if their cases are complete. USCIS and NVC will not wait for incomplete files and will move on to the next in line who is eligible and able to close out and to do this, they need to move dates forward.

what about indians, we have to wait again & again.

unfortunately my iv interview date go cancelled last aug after finishing all other formalities including medical.

any idea, when it will be - - - - m pd is nov 2005

in my opinion, no hopes for any great movement in the indian eb3 nos. only 2,800 eb3 visas allocated per country and we have many waiting in queue. for any movement eb3 row has to become current first then the extra viass will spill over to older pds in eb3 irrespective of country quotas.

so according to me there is nothing to look forward to in the remaining vb of this fiscal year.

Want to ask your opinion on cases like ours with pd's of 2005. We were asked to submit updated forms last year and our cases were completed as well, right now I believe NVC is asking another one. In this case this will be the 3rd time our case will be completed. Do you think we'll make it before dates retrogressed back? Is it normal that NVC asks new forms from case that were already completed and hold it again when dates go back? Is it possible that they already assigned a visa number for us that is why they're asking for updated forms?... I fear that It'll be just a cycle like what happened last year.

We have to wait for the actual request first. Let's just wait for it when it reaches your lawyers then take it from there. Don't take what was e-mailed to you literally. Most of it are prepared auto-responses.

Next year (2009), yes there is a possibility. No guarantees, however as a case being closed out depends greatly on many things. The situation also varies greatly from country to country and if there will be slight improvements to the current EB-immigration system in the next fiscal year.

If the trend continues, those undergoing CP will benefit more than those who underwent AOS.

Some immigration lawyers are now advocating clients to go through CP instead of AOS even if visa categories becomes Current because doing so will just add to the backlog as they see USCIS unable to process their current 800k backlog for years to come and so the DOS will keep doing what they have been doing the last 2 fiscal years - keep moving dates forward sometime in the middle of the fiscal year so that those undergoing CP can use the alloted visa quotas because USCIS cannot.

My uscis account once said that receipt of my application was on jun 29, 2006.

Right now it says : On feb. 9, 2007, we have shipped this approved or reaffirmed case to the DOS for visa processing.

Processing time for Nebraska center at the moment is dec. 29, 2006 for schedula A nurses.

How am I supposed to know which among the first two dates is my PD? Or I don't have a PD yet?

PD date is always the date that the petition was initially received.

You are probably right but last year with all the rush to issue visas around June 2007 India was reported to have received a lot more than their 2800 alloted visas. I am assuming because that was where the completed files were located. So those per country allotments are not always set in stone.

There were really a lot of strange things that happened last year, including consulates abroad cancelling scheduled appointment dates and passports that were already given but given back saying there isn't a visa number anymore when in the past someone with a scheduled appointment already meant a reserved visa to them.

Hope nothing of this sort happens again this fiscal year.
