Is This Illegal?

:uhoh21: I am an RN DON at a rural nursing home of about 45 residents. We are currently getting ready to move to a new nursing home in town. We have an interim administrator and he asked me to do something I don't feel comfortable about doing. State came in around Christmas and wrote us up for not having weekend RN coverage every weekend. My new administrator asked me to come in this weekend and clock in and out for Sat. and Sun. but not to stay....just to clock in so it looks like I was there. I can't work 7 days a week and they haven't hired anyone. I feel like this is lying and that I might be risking my licensure. Is this illegal? Could I lose my license? I don't want to lie. Any input would be much appreciated! Thanks!

all of the "managers" at my facility are mad because I won't just fill in the gaps in the MARs with my initials and that I won't do what this administrator is suggesting.

The problem is all these managers - they're the ones who should be leaving - and a higher authority needs to be made aware of what they're trying to do.

Lousy leadership here......makes me wonder how common practices like you describe are in health care facilities.

Posts like yours make me happy about where I work. I can't imagine our ED ever suggesting such a thing.

Yeah I tried to talk to a superior administrator and they know all about it...apparently that is just common practice...and I talked to some of the older nurses, and they said that they see this sort of thing in alot of nursing homes....Louisiana is not the best place to have a family member in a nursing home!

As they say.. if it doesn't seem right... it probably isn't. Though one could enjoy extra pay, but I am quite sure you are probably salary, so there isn't extra pay... just the same it is definately illegal. If you had a grudge against this administrator, you could have HIS license in trouble for reporting this. Save your license and your integrity, and don't do it.

I think it's clear that your days are numbered with this company; my advice is to disassociate yourself from these slimeballs immediately before you end up without a license or are excluded from Medicare participation as a provider.

The fact is their scheme is going to blow up in their faces; Surveyers let a good deal slip by them, but it is clear that they are on to something here.

Act now and inform all relevant licensure Boards and your employer in writing by certified/return receipt mail why you must resign your position in order to preserve your unemployment benefits.

If they'll cut corners like that, they aren't particularly concerned with the welfare of their residents are they? That's an administrator that REALLY REALLY wants to get sued huh?

I think I'd run for the hills as fast as I could. Someone who would lie like that......I wouldn't put it past him to go in and clock YOUR time card HIMSELF, if you refused.

Another thought....I wonder what he'd say, if you responded, "Well, put that request in writing and I'll consider it." {Of course, knowing you wouldn't, but just to see what he'd say if asked to put it in writing.}

He's a sleaze for even asking you to do such a thing. Like someone else said, no telling what else he lies about.

You know, I called my new DON on a saturday and told her she didm't have RN coverage for sunday. I was working the floor, but she had me call EVERY RN that works there, even the QA nurse and stuff. She couldn't find someone so she cam in sunday for several hours and did "paperwork" for a few hours with her kids in tow. It's just not right

Don't do it! It's illegal, unethical... And if you something happened and you were caught, do you think your administrator would stand up for you, even though he asked you to do it? Not a chance...I'm sure he'd hang you out to dry!!
