Hello all,

I am looking for advice please!

I was accused of being impaired at work. I was taken for a drug test and provided two separate urine samples, hours apart. The first sample was falsely positive for oxycodone, very high level with no metabolites. The second was completely clean. The hospital required me to report to HPRP and I refused, was fired. They stated that they would report me to the Michigan BON.

That was 6 months ago and I have heard nothing!!!! My license remains in good standing. Is it normal for it to take this long?? What are you experiences with the time frame from incident to notification from the state?

Is the HRHP a monitoring program? I am recently on probation with the Board in Maine. Part of my probation was to enter into a monitoring program with Medical Professionals Health Program.

My issue isn’t related to diversion but from time of complaint to receiving info on an informal conference was one year for me. It’s the longest process and so nerve wracking. I completely understand how you feel.

I was false accused of diverting. I had the investigation with the board with a lawyer present. The board then sent me a letter stating that they were referring me to HPRP. A month later I then received a letter from the state that they found no error on my part and that my case was closed with them. I refused to participate with HPRP intake. I got an independent addictions evaluation who stated I had no substance abuse issues. HPRP then wrote the state and said my case was closed with them because of non-compliance. My lawyer continues to fight this and currently I am still working as a nurse. It has almost been one full year since I was contacted by the board and over 14 months since I was fired for diversion speculation.

Did the BON want you to have an evaluation with HPRP? I know I was told that if you get an eval by an addiction specialist that have to be “hprp certified” but your letter for the BON stating your case was closed should have been enough proof. I’m in MI too. Actually I have my interview tomorrow. 

It was. It is the only HPRP DOC in my area. I sent all the information to HPRP. I did not have a contract with them. I am paying a lawyer to fight this for me. Do you have a lawyer? I wouldn’t do the intake assessment for HPRP. I had proof from one of their doctors saying I didn’t have a problem. I didn’t do an intake assessment because doing an intake assessment is kinda admitting you have a problem.

As long as you can renew your license with BON... I don’t think HPRP can have any affect?! Keep up the fight!

Update on my case.... in October I received an email (not a letter) from the board stating there is no formal decision on my case and that I was “allowed” to do a non regulatory HPRP eval. 
I discussed this with my lawyer and he recommended that I proceed with their evaluation. If I didn’t, the board would suspend my license. The whole thing was beyond stressful! HPRP made me drug test weekly while going through the evaluation. I had to be evaluated by one of their addictionologists. The first doctor I made an appointment with cancelled at the last minute due to illness. The second doctor completed her full assessment before falling ill and being unable to submit her report. So I had to see a third doctor who finally completed and submitted the report! This took months while drug testing the whole time and a lot of money. Finally, today I received a letter clearing me from HPRP as I did not have a qualifying diagnosis, case closed! 
my lawyer said this is obviously good news. But I may still hear from the board in a few months recommending administrative action. 
has anyone had a similar experience? Obviously I am relieved but don’t want to celebrate yet in fear of what the board may do in the future.
