HIPAA VIOLATION!

Published

I came across SEVERAL sheets of paper containing patient names while I was packing my ex's (who is a LPN) stuff. In addition, I also found a lot of medications (non-narcotics) and called the police who confiscated all of this including the patient names.

I talked to my ex (who of course is playing dumb) and he said that the place he is working at isn't going to press charges and is in the process of trying to work for the same company somewhere else. I am a RN and I don't work for his company, a nursing home that I'm sure will try to sweep it under the rug because they liked him so well.

However, who do I report all of this to besides the police? I contacted ISNAP and they mentioned we will get the Attorney General involved. What about the HIPPA violation? It is a violation to have patient names outside a healthcare facility in which it came from correct? I don't know what to do...I want to take the right steps! Please help!

WOW, just WOW!

Y'all know the saying, "hell has no fury like a woman scorned". I'm with everyone else, this seems more like a revenge thing than anything else. You've done enough. I hope you get some kinda satisfication out of knowing he is probably screwed for life. Does that make you feel any better?

You could have just busted the windows out his car with a crowbar and that would have made you feel better too.

Just remember, whatever vibes you put out in the universe will come back to you 10 X fold. I just hope and pray you are never on the receiving end of this.

I'm not for a minute buying the whole "ethics" thing. This sounds more personal than some "ethics" to me.

If it was just their names... that doesn't sound more confidential than the phone book. Am I missing something?

I wouldn't have even gone that far. Sometimes(usually all the time) I go home and I still have my patient list with me. It only has names and room numbers. I even re-use the paper as scrap paper and when I am done throw it away. I doubt someone would go through the garbage to find it. Did I break hippa? maybe, but I think everyone at some point or another will. Do you go reporting everyone? no.

I personally think you are taking it too far. like other said let it go. You are just going to end up looking like the bad guy.

Love it!! I have many times forgotten a pt list or something related directly to one pt in my pocket or lab jacket at day end. We've all done it. Or in a rush when on the way to give a tylenol and the pt in the next room codes so in the pocket went that tylenol. Not the ideal thing to do but it happens. I dont find or realize it till I get home and they end up in a little pile on my dresser top lol. I beleive (as one who has been on your end) this is nothing more then a vengeful behavior and keep in mind karma's a dog. It may come back to bite you in the royal rear-end down the road. He's an ex, let him be an ex and move on. If you continue this way you will end up being more bitter with yourself down the road and looking back saying to yourself "how stupid did I act". Just my 2 cents. So your plan is get even by possibly taking his livelyhood from him and possibly having legal action on his record? That's really going to heal your heart? Let it go and move on with your own life and happiness. Would you be doing this if the relationship was still there and things were all peaches and cream? I doubt it.

Ditto to most of the above... I especially enjoyed the woman scorned, and the ref to a praying mantis... Just off shift and needed a good laugh lol :)

Wow, in revenge mode? I am glad I am not your ex...seems like you went a little extreme on this! You turned him in, be done with it; it sounds like you want to go out of your way to ruin his life. I am sure your perfect and there is nothing he can get you in trouble for...are you doing this because of ethics or because you are revengeful? Sounds like you are doing this for selfish reasons instead

Dang....Hope you are too good to stick any thing like tylenol or such in your pocket. Will you turn yourself in for taking a report sheet home with you. Get over it.

I am guilty of your ex's travesties as well.

In fact, after I read this I decided to see what meds I had in my "nurse box" (my mom has a box for the express purpose of me emptying out my pockets every morning when I arrive home). I have...Senna, Colace, and Lisinopril, plus empty Dilaudid and Phenergen bottles. I also came home with someone's armband once (the reason why escapes me, but the patient had another one on at the hospital, she wasn't armbandless!)

Lock me up...

Ya know..... he could just as easily say the meds in question must be yours- after all, you did live together! Let it go- you seem to have done enough to ruin him for now.
