In my state it specifically asks if you were convicted of a felony....If it asks if you were convicted of a felony or misdemeanor and the answer is no, it's no on your application as well.

Just because you were placed in cuffs doesn't mean you were arrested. If you were not charged with anything and they let you go, then you were not arrested. I would check no.
Thanks ckh23 and SweetseRN. also, (i know this is legal info i should gather in other ways but...) i was 18 when i was pulled over and asked if i had been drinkning. i replyed yes and was breathalized. i blew a 0.038. being that i was under 21 they suspended my license. its over four years later and i cannot find any record of my suspension or breathalizer report. what do you guys think? its not in my public records.

if its not on your record than its not there relax, you were young and hopefully grew up! calm down if anything consult a lawyer. Take them copies of you state criminal background check, and FBI check. Did your nursing school not help you with this? My nursing school helped us fill these forms out. Good Luck

"not in my public records." that would be your answer. if you were applying for the fbi or the coast guard academy, they'd find out about it anyway. but for any other kind of work, you tell them the truth if they ask you about a conviction (which you don't have, so the answer is "no"), and other than that, you put it out of your mind.
:nono:well, you resolve not to do it again, of course, but otherwise, out of your thoughts is acceptable.

If "they" suspended your license for 4 years then you have a conviction for something. What did the judge say when the license was suspended due to a DWI?
@ tyvin. it wasnt suspended for four years. four years ago it got suspended for six months for driving with alcohol in my blood while under 21. no conviction, no court date, no recored. my public record only shows my traffic infractions such as a "tail light out" and "rolling through a stop sign." i have no misdemeanors or felonies. thanks for the replies everyone.

Some states have separate proceedings for things like this. My brother was busted for DUI (He was completely 100% guilty BTW). His court date (with the judge) kept getting postponed, but he still had to go before somebody with the DMV. Since a drivers license is a priviledge, not a right, they suspended his license for 6 months. This proceeding had less of burden of proof than a court needed because it's in the fine print that whatever the state giveth, it can taketh away. My brother ended up with a sneaky lawyer who got the charge dropped from DUI to wreckless driving several months after his license had already been suspended.

You were detained, not arrested.

If you weren't booked then there is no record.

I also think the answer is "no" to the arrest question; but the diver's license suspension Will stay on your record! I would ask your program adminstrator for help with answering that (somewhere) on the application.
Even without going thru the courts the states can take 'administrative' actions against your license and these will stay on your record! (If you go to the DMV and ask for a printed copy of your driver's record, I'll bet it's on there) It won't show up on case.net because it was not a court case. The state boards also have access to waaaayyy more information about you than any police officer could ever pull up on you during a traffic stop. (This is because they need to know to whom they are issuing licenses.) ... and don't forget you are suposed to be 'honest' and you gave them permission to look! --- This make it twice as bad when you have to come back after a year of waiting and say "...Oh, I didn't think you would ever find out about THAT!"
