I have applied for a work visa for the position as a dialysis nurse. I was filed last april 1 2009 and was wondering when will i get to have a visa? Anyone with a similar status of mine???:specs:

You really need to ask around where you want to live. I suspect many will not use it with the current US job situation plus as a new grad you probably do not meet the specialist requirement part of it.

hi, im a foreign citizen but i graduated in the US w/ a BSN degree. my OPT expired early this year so i had to stop working. my employer filed an immigrant petition and it was approved but i still can't work b/c immigration is closed. right now, i am pursuing my graduate studies in the US under the F-1 status. i want to apply for an H1B visa but my employer told me that they can't file an H1B petition for me since they don't have any positions that specifically require a BSN (even in specialty units) since they can just hire nurses w/ associate's degree. does anyone know any agency or places that petitions H1B visa here in the US?

Your previous employer is correct. Unless you have specialty experience or certification, you don't meet H1B criteria.

Hi, Thanks for replying. I worked at the an Oncology unit for a year for my OPT. What is this specialty experience or certification? I read an article that nurses who work in ER, ICU, Oncology, nursing rehab are eligible for H1B visa. The employer who petitioned me (for GC) said they can't petition H1B even if I get hired in ER, ICU because these nursing positions are not specifically for nurses w/ BSN (they can just hire ADN). Is this the same for all hospitals/healthcare institutions?

Certification would be qualifying and sitting for the certification exam in your specialty.

You have to have several years experience in a specialized field. If you don't have several years experience is a specialized field, then you don't meet the requirements for H1b visa. Foreigners are required to have a BSN or higher. Usually ADN graduates are ones here in the US who are legal residents or citizens and they don't have to have H1b visa.

1. The nurse must hold at least a Bachelors degree in nursing (e.g. BSN); AND

2. The position must normally require a Bachelors degree.

the most success in these scenarios:

A. The hospital is offering the nurse a position as a Clinical nurse specialist (CNS), Certified registered nurse anesthetist (CRNA), Certified nurse-midwife (CNM), or a Certified nurse practitioner (APRN-certified) Critical care and the nurse holds the certification;

B. If the nurse will be working in an Administrative position ordinarily associated with a Bachelors degree, such as Charge Nurse or Nurse Manager;

C. If the nurse will be working in one of these specialties: peri-operative, school health, occupational health, rehabilitation nursing, emergency room nursing, critical care, operating room, oncology and pediatrics. And the hospital will attest that these roles are only offered to those with Bachelors degrees. Some magnet hospitals have the BSN as its standards, and these make great destination hospitals for H-1b rns.

For oncology the OCN test and the hospital would have to make all nurses have an OCN and BSN, or be a CNS ( which requires a MSN).

Is it impossible to apply for a H1B visa if you are a foreign us trained student with an ADN? that would make the ADN program pretty useless..

You need to have a Bachelors in a specialized field and have several years experience. It doesn't necessairly be in nursing because there are lots of people who are here on the H1b visa. But for nurses it's a minimum of BSN with several years experience in as a nurse who specialized.

I came to the U.S. with F-1. I am on H1C status now.

My H1C is expired on June, 2011.

I am looking for H1B hospital.

I am trying to apply to the outpatient chemo nurse position at the university hospital.

I had a year inpatient-oncology nursing experience at the university hospital and a year and a half at the community magnet hospital.

If the position requires BSN,Chemo Certification,CPR(I have BLS and ACLS.) and prefers OCN, is it possible to get H1B visa?

The only relevant thing you posted is that the position requires BSN. There is no such thing as a "H1B hospital". Most big hospitals have H1B staff, but as you have read, it doesn't matter if the nurse has a BSN, only if the position mandates that a bachelor degree is the minimum requirement. Chemo certification, ACLS, OCN do not matter because they do not require the nurse to have a bachelor degree.

If you can find a position that the PD states the encumbent must have a BSN minimum, then it meets H1B requirements. Whether YOU meet the specialist requirements is up to the consulate officer at interview.

its my first time to contribute in this forum. I was so eager to apply for h1b, (as evryone desires in present retro. ) nyway i just received my visa screen cert. last october and recently to found out of the h1b opprtunity as my friend told me i can be qualified as i am working here in middle east as OR nurse of 4 years exp. But my problem I dont know if there is still h1b available for me, and is there any agency will select or prioritize me for h1b? because i didnt have any agency as i am the 1 who shouldered all my exams and visa screenin.do u see any hope that I can be file for h1b even in the beginning of 2010?I already sent hard copy of my credntials to popular agency in the philippines and 3 weeks from now I didnt got any reply from them?Im thingking that the H1b is deplted already. If you knew some institution or agency willing to sponsor me your referral is greatly appreciated.am i having a litle percentage for h1b visa availabilty as I just finished my Visa screen last october?
