I have applied for a work visa for the position as a dialysis nurse. I was filed last april 1 2009 and was wondering when will i get to have a visa? Anyone with a similar status of mine???

Hi Silverdragon. Is a 6 month work experience in a specialized field qualify one for H1B visa among other things?
no at six months you are still a beginner, to be competent you would need to be able to pass a certification test which most require 1-3 years experience.

Must the experience in the field be current? Or can there be a time lapse? What I would like to know is where is everyone getting this information about obtaining a H1b visa when they don't qualify for it?
Everyone seems to be trying to take the easy way out. If something sounds too good to be true, then it probably is.

You can apply for an adjustment of status, but it's highly discouraged as INS is going to red flag you right away and you will still have to wait the many many years that people are waiting in order at a chance for a visa. But if you're looking at a H1b visa you might get one, but will still get red flagged as you're here on a tourist with the soul purpose to adjust your visa. Which you're abusing the tourist visa with what you're attempting to do anyway.
hello..I have received my H1b visa approval today..Thanks Lord!!I hope this will inspire those who are waiting in line especially those fellow nurses..I am task to have my embassy interview be scheduled next week..Hopefully praying things will work out fine ..:)

hi about that korean thta have given a H1b visa. how come that he has given a visa and knowing that his files is already reviewed by uscis i think, so how come that the 2nd lawyer told him thta is it not right when this korean already has a approved h1b?
Joyce it sounds like you don't qualify for a H1b visa. I also want to mention that they're investigating H1b visa holders in California (unsure about other states) because of people abusing that particular visa. If it turns out that it's being abused a lot, you never know the government might just do away with those visas. That's why the laws constantly changing because of people who abuse priviledges, and that goes for everyone, not just foreigners. If your caught using a visa that you don't qualify for, you might be deported and wont have the priviledge of returning for several years. Think long and hard about what type of visa you apply for because in the end the consequences exceed far more than the visa is worth. Good Luck
how come that an applicant has given the H1b visa without knowing yet or checking first if this applicant is qualified? i mean, you'll be given the visa first then, when you start working a background investigation will proceed? I don't understand. when will the checking of qualification took place? thanks!

hi mosol just want to ask how long did you wait to get the approval? and your application was approved without having an interview first? so it means they will approved you first and then you will have the interview?? am i correct? im just confused because i have the same application as yours right now my case status was resumed last sept 4 and im expecting to receive mail within 60 days after they received the additional evidence i hope i will get approved.. need more prayers right now..
To salve:Thank you very much..I hope to see you in Maryland,too..if God permits..To Nurseako:I applied to Cambridge last December and was filed on april 1..My receipt notice was dated April 28..I got RFE on May 30 and case resumed on July 14..Consequently,my approval came around last week of July according to my employer..My approval notice has to be sent by my employer via Fedex..Right now,i am preparing for the embassy interview which I am about to schedule around last week of August if God permits..I'll post after I'm done with it..Hopefully praying for a successful interview..God bless us all..

To be issued a visa the lawyer/employer has to prove that the applicant meets job requirements and that they can not employ someone either USC or PR. Checks are supposed to be done before the visa is issued and you attend a meeting supplying original documentation so that the visa officer can verify the originals. This is what I have seen written by others that have applied for H1b
Getting visa approval doesn't guarantee that you will get the visa. The visa can still be denied when you go to your interview.

so you mean those who have given h1b visa then found out that they are not qualified is done by fraud?

If they are found not to meet requirements they can have their visa revoked and could result in a ban
