I have applied for a work visa for the position as a dialysis nurse. I was filed last april 1 2009 and was wondering when will i get to have a visa? Anyone with a similar status of mine???
i'm currenlty working on my OPT. my lawyers are reputated lawyers that my hospital recommended me and all the hospital paper works are through them.
Well, thats what my lawyer said and she did show me the paper from the government saying that and also all licensee can apply for H1B, doesnt need any specialization or anything.the result will take 2-4 months and express result will be within 15 days-1 month if you pay $1000 extra. i dont know how true it is but i did saw the paper from uscis about that.
If you do a google you will find much about the H1b and you do have to have a Bachelor or higher
Q : What is an H-1B?
The H-1B is a nonimmigrant classification used by an alien who will be employed temporarily in a specialty occupation or as a fashion model of distinguished merit and ability.
A specialty occupation requires theoretical and practical application of a body of specialized knowledge along with at least a bachelor’s degree or its equivalent. For example, architecture, engineering, mathematics, physical sciences, social sciences, medicine and health, education, business specialties, accounting, law, theology, and the arts are specialty occupations.
ya! i'm aware of what H1b is really about. i googled it all day long but failed to find any info regarding that so i'm worried if its fake. i asked my lawyer to send me a link or a copy of that new petition that just came up. if she send me one i surely will post it. i truly hope that its not fake.
if my agency will file me this month (august) or maybe next month under H1B, can i still get visa this yr? How long is the usual processing time?
There are still visas left this year and processing can take a month or so it does vary depending on whether they accept your application or whether they request further information. If you go back a few pages there are a few there that have posted their timetable
That memo really provides very little useful information. It does, however, state that the information in the memo pertains to persons with a bachelor's, master's or doctorate degree....not an associate's degree (as you stated in a previous post.) The memo simply provides clarification for USCIS guidelines--it's just a memo, nothing more--so I am not sure why your lawyer would send it to you.
It doesn't change the fact that the H1b visa is for experienced nurses. Not students. Not new grads.
Don't know why people can't understand this simple concept. No amount of praying, wishing, or Googling is going to change that! :chuckle

If you're a student, then you don't qualify for H1b visa since it's for people who specialize and you need experience in that field. Read this whole thread, you don't qualify for a H1b visa.
