A ltc nursing facility gives 30 days notice that it is closing. Here are some of the demands it is making. Relocate to another facility 120 miles and take a job it is offering there or 1. lose your PTO 2. lose your severence 3. no use applying for unemployment because you were offered another job and you did not take it. This is the short list of the dirty tricks they are pulling but I am wondering if these items can be contested.

Call your state unemployment office and ask if declining to take a job 120 miles away would really disqualify you for unemployment.

Not sure who you should ask to challenge the loss of PTO and severance. I would definitely look into whether they can do this legally or not. I'm sure the company is hoping you'll all believe they're telling you the gospel truth and fold like a house of cards.

Hope you can find some better answers than they are offering you.

Is this a facility that has a contract? If they are contractually obligated to offer alternative employment, they may be trying to follow it. Regarding severance pay and unemployment, check out your local unemployment office and see if this is the case. Unemployment varies from state to state, and severence pay varies from company to company. Good luck.

The unemployment and PTO things are probably not legal. Contact your state DOL and unemployment office.

Severance, unless under contract, they can probably withhold.

I can't see how they can say that offering a job 120 miles away (2+ hrs or more if we are in that same area) is okay.

Some of us have directed you to the Unemployment Office and other official agencies. That's not legal advice. It's just plain common sense. These are the folks who know the answers and they have no reason to be dishonest with you.

I really hope you can find a better job and leave this place behind you.
