Shift Diff taken away

The facility i work for offered a shift diff about two years ago to all day nurses from 3 pm to 7 pm with agreement that you had to work the last four hours to receive this amount for that time. Now this company has changed the requirements taking that shift diff away from those same nurses and changing times to 5 pm to 8 pm as requirement to qualify. This reduces pay for these individuals by $300-$400 a month. for some this amount is not much but for others this is food in the mouths of their children. This is wrong in my eyes. Is this legal in the state of Texas?

LOL. Check your department of labor but a shift diff is generally just a perk.

It's not illegal to change or eliminate shift differentials. Disclaimer: I am not a lawyer. And I think you will find that most people on allnurses are not lawyers.

In my state, the employer can pretty much change the conditions of employment as they see fit, as long as they don't go against employment law. You can get your definitive answer from your state department of industrial labor, i.e. call the Labor Board.

Lol at the idea of hospital unions in Texas; it's definitely a 'right to work' state.

Apparently they aren't in need of help as much as they were before.

That's the way I would take it, and I would make my decisions accordingly.

Let me guess, shift diff is 5p-8p, but you are in trouble if you don't clock out by 7:15.
