Do facilities care about convictions or arrests as well?

I want to know if hospital/nursing home facilities are asking for arrest records/charges or actual convictions?

My conviction had been expunged, so I have no conviction, but since arrest record is impossible to seal (CA)--would facility employers see the arrest on fingerprint check/FBI check?

Depends on the facility, usually nursing homes do not care about your arrest records. They only want to know if u have been convicted of a felony or a misdemeanor and if so, what was the nature of the crime. Hospitals, im not sure about, but i cant see them going that far since your record is clean.

That's a thing that my record isn't that "clean"--there's NO real expungement in the state of California! They offer you to plea no contest to something you're not guilty of lying to your that your conviction will be "removed", but in reality CA "expungement/dismissal" only allows you to say "No" on applications to private employers not associated with healthcare---the conviction WILL show up, forever, on your DOJ report (with a notation "dismissed")--there's no way to seal and destroy, really. Moreover, one (idiot) attorney told me that one has to always answer yes to convictions question even if it's been expunged. How's that? I mean I *withrew* my guilty plea and entered not guilty and my conviction was set aside (attorney wanted me to pay him of course, but I can spot liar attorneys....) So, yes, "clean" record doesn't exist in CA after expungement--it will show up as "dismissed". Of course, it's much better than a plain conviction on record. But also, apparently, applying to government organizations for work or, in some opinions to any job that requires licensing (aka nurse, OT, PT, etc) one ALWAYS have to say "Yes, dismissed" in the " have you been convicted" question.

I just interviewed for a LTC facility today. I disclosed my felony arrest (dismissed) in the interview. The application asked about convictions only, I have 2 misdemeanors: leaving the scene of a personal injury accident and unauthorized use of a motor vehicle. The ADON said that the arrests shouldn't matter and the misdemeanors won't disqualify me but I am sooo nervous awaiting a phone call.:icon_roll

Did Any of you ever got the position? I also had my conviction expunged and was offered a job but they are waiting for the background check which will take a week before they do a Formal Job Offer. I didn't disclose it on my application because my attorney said that by law Im not required to unless it's applying for a license, public office, or winning the lottery. I wonder if they will see it? Im afraid that if they do they will think that I am dishonest and a liar. :(

Arrested? Dismissed? Convicted? Sealed? Expunged? If you are arrested, in this country, your file is forever marked as such. It doesn't matter what happens next or finally. Every BON will know you were arrested, and if it was dismissed it does not matter- you are marked, for life. Your RAP sheet will always and forever indicate that arrest. Every BON will ask if you have ever been arrested, and expunged , sealed, dismissed, etc. means nothing to them. Therefore, regardless of what wording is used on any work application, for the remainder of your life, you may as well tell them you were arrested, for what, the end result, and be upfront. Since every BON, a government agency, knows every detail- the potential exists for every employer to also know every detail. there is simply no waht whatsoever to play word tricks.

I am a new grad who is lucky enough to have a job offer yet regreatfully has an expunged record. I already interviewed (because I got lucky)yet I have not filled out the job application yet. I am going to have to fill it out and I am afraid, I dont want to open up a can of worms if I dont have to. Especially because one case involved "under the influence of a controlled substance":( It was over 10 years ago when I was dumb kid(19). McBunny Did they find it on your record????? I was also told that I leagally do not have to disclose it yet that it may show??? I want to be honest because I dont want to lose the job opp. I also want this past of mine to be put to rest and dont see them hireing me with a record in this economy with so many other applicants without records. ADVICE PLEASE

I have great news! They offered me the job. I don't think that anything came up on my background either otherwise I'm sure that they would have asked me. If you live in California then you really don't have to disclose it it. I am currently doing orientation and i love it at my job. I know that I stressed a lot since I felt like no one gave me the right answer to my question. I however hope that this can make you sleep better at night.
