I have an assault charge and went in front of board of nurses. First, does anyone know if hospitals and medical facilities will go through with Job when background check comes back with assault charge? It was investigated by the board with the initial charge of a felony. By the time I had my hearing the judge had dropped it to misdemeanor which board was not aware so hopefully this helped some. The incident was of me questioning police why the wanted me to get on police car during welfare check, they  gave no answer and as I continued to understand what was going on the forced me in the car I pul my foot up on side door and in doing so stepped on officers thumb....he charged me with assault. Obviously I agree a charge that is assault looks horrible on any record for any job and truth be told I can't even believe the situation at hand could be in the slightest way described as assault. Anyway without any further information this charge makes it sound as though I am violent hurt someone physically with violence and this is not accurate at all. Will anyone in the hire me with this charge. Thank you for any information 

My advice to anyone encountering a situation with police is to DO WHAT THEY TELL YOU. Accidental or not, your resistance led to the assault charge. You will now need to include that every time you renew your license and on every job application. If you fail to disclose with a prospective employer and they find out, you will be terminated. Good luck.

In a situation like this, the best approach would be to have been to get a lawyer, now you can try the process to get it expunged.

As a former hiring manager it is up to the hospital to decide if they want to hire a nurse with a flagged license no matter what the flag is for. I hired a nurse with a flagged license and he was one of my best employees. Hiring him required a meeting and approval from the Chief Nursing Officer. That's how serious it was and is. His offense was not for an assault though. As others have suggested you should seek legal counsel who can help you make an appeal to the state board. I've sat in on state board hearings and the board wants to see behavior change from the nurse. That said, the state board is not our friend. They are there to protect the public. Seek legal counsel.
